Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced.
Reason: To ensure that the details of the development are satisfactory and to comply with Policies G2, D1 and H4 of the South Oxfordshire Local Plan.
That prior to the occupation of the proposed bungalow, the proposed means of access onto Charles Road is to be formed, laid out and constructed to the approval of the highway authority's specifications and that all ancillary works specified shall be undertaken.
Reason: In the interests of highway safety and convenience and to comply with Policies G2 and T1 of the South Oxfordshire Local Plan.
That before the proposed access is first used, the existing access onto Charles Road, shall be permanently stopped up and thereafter shall not be used by any vehicular traffic whatsoever.
Reason: In the interests of highway safety and convenience and to comply with Policy T1 of the South Oxfordshire Local Plan.
Before the development is first occupied, parking and manoeuvring areas to be provided as per submitted plan BS135/71.
Reason: In the interests of highway safety and convenience and to comply with Policy T1 of the South Oxfordshire Local Plan.
That the hard and soft landscaping scheme indicated on submitted plan BS135/71 shall be implemented during the first planting season following the completion of the development and thereafter maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or an equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To help assimilate the development into its surroundings and to comply with Policies G2 and C9 of the South Oxfordshire Local Plan.
Notwithstanding the provisions of Article 3(1) of the Town and Country Planning (Use Classes) Order 1987 the building hereby permitted shall be used only as a dwellinghouse (as permitted by Class C3 of the said Order) and /or for the provision of residential accommodation and care to people in need of care (comprising a use within Class C2 of the said Order) provided in the latter case that the provision of accommodation and care shall be limited to no more than four people in need of care by reason of their disablement.
Reason: To safeguard the character of the area and to ensure the development is not unneighbourly and to comply with Policies G2 and H4 of the South Oxfordshire Local Plan.
