Conditions / Refusal Reasons
That the development be carried out strictly in accordance with the particulars of the development contained in application S.06/07 as shown on plan numbers 782028.004.002 1821 A, 1822, 1838 A and 1844 accompanying the application except as controlled or modified by conditions of this permission, unless otherwise agreed in writing by the Head of Sustainable Development. Reason: To ensure the details of the development are carried out in accordance with the application as approved.

That the development must be begun not later than the expiration of three years beginning with the date hereof. Reason: By virtue of the provisions of Section 91 (1) (a) of the Town and Country Planning Act 1990.

Except with the prior agreement of the Head of Sustainable Development in writing, the site shall not be opened and no operations authorised or required by this permission shall be carried out and plant shall not be operated, other than during the following hours: 1st April until 10th September Operational Hours: 07:30 - 17:30 hrs Friday to Wednesday 07:30 - 20:30 hrs Thursday Opening Hours: 08:00 - 17:00 hrs Friday to Wednesday 08:00 - 20:00 hrs Thursday 1st October until 31st March Operational Hours: 07:30 - 17:30 hrs Monday to Sunday Opening Hours: 08:00 - 17:00 hrs Monday to Sunday No operations shall take place and the waste recycling centre shall not open on Christmas Day, Boxing Day and New Years Day Reason: To protect the amenities of the local people. (Policies: EN2, EN4 (OSP2016); W3, W7, PE18 (OMWLP))

Prior to the commencement of the development, details of the proposed external lighting arrangements for the site shall be submitted for approval by the Head of Sustainable Development. Any scheme that is approved shall be implemented within six months of the date approval is given. Reason: In the interest of the amenity of the local environment. (Policies: G2, EN1, EN2, EN4 (OSP2016); W3(c) (OMWLP))

Any above ground oil storage tanks should be sited on an impervious base and surrounded by suitable liquid tight bunded compound. No drainage outlet should be provided. The bunded area should be capable of containing 100% of the volume of the largest tank and all filled pipes, draw pipes and sight gauges should be enclosed within its curtilage. The vent pipe should be directed downwards into the bund. Reason: To prevent pollution entering the water environment. (Policies: EN10 (OSP2016); EP7 (SOLP2011))

That details of surface water drainage works shall be submitted to and approved in writing by the Head of Sustainable Development prior to the commencement of the development. Reason: To prevent pollution entering the water environment and in the interests of public health. (Policies: EN10 (OSP2016); EP7, EP9 (SOLP2011))

That prior to the commencement of the development, details of the proposed fencing to the site boundaries shall be submitted to and approved in writing by the Head of Sustainable Development. Reason: In the interests of the amenities of the area. (Policies: G2 (OSP2016); W3 (OMWLP))

That the land be landscaped and planted with trees and shrubs in accordance with a comprehensive planting and landscaping scheme first approved by the Head of Sustainable Development and that trees and shrubs so planted be properly maintained and that in the event of any of the trees or shrubs dying or being seriously damaged or destroyed within a period of five years from the completion of the development a new tree or shrub or equivalent number of trees or shrubs as the case may be, be planted and properly maintained in a position or positions as first approved by the Head of Sustainable Development. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development. (Policies: G2 (OSP2016); D1 (SOLP2011))

That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season following the occupation of the buildings or the completion of the development, whichever is the sooner, and any trees or plants which within a period of five years die, are removed or become seriously damaged shall be replaced in the next planting season with others of similar size and species, unless the Head of Sustainable Development gives written consent to any variations. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development. (Policies: G2 (OSP2016); D1 (SOLP2011))

That the boundary foliage on the southern side of the junction of the site access road with Old Icknield Way shall be cut back to improve visibility. Reason: In the interest of lighting safety. (Policies: T8 (OSP2016))

That prior to the commencement of the development, details of measures to ensure the protection of the area of bee orchids within the site shall be submitted for approval in writing by the Head of Sustainable Development. Any measures approved shall be implemented. Reason: To ensure the protection of the bee orchid habitat. (Policies: EN2 (OSP2016); C8 (SOLP 2011))

That no development shall take place until a scheme and programme of measures for the suppression of dust has been submitted to and approved in writing by the Head of Sustainable Development. Any measures agreed shall be implemented during periods of dry weather. Reason: In the interests of the amenity of the local environment. (Policies: EN2, EN4 (OSP2016); W3, W7, PE18 (OMWLP))

That prior to the commencement of the development, any further surveys that may be required to establish the presence, or not, of great crested newts on the site, shall be undertaken and the findings reported to the Head of Sustainable Development. Reason: To ascertain the presence of great crested newts and ensure the preservation of their habitat. (Policies: E2 (OSP2016); C8 (SOLP2011))
