Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced. Reason: To ensure that the details of the development are satisfactory in accordance with Policies H4 and E5 of the adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of Article 3 of, and Class A of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no extensions or outbuildings shall be constructed to the dwellings unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To protect local amenities in accordance with Policy D3 of the adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order) the garage accommodation shall be retained as such and shall not be adapted for living purposes without the prior grant of planning permission by the Local Planning Authority on a formal application in respect thereof. Reason: To ensure adequate parking facilities remain in accordance with Policy T1 of the adopted South Oxfordshire Local Plan.

That a scheme for waste collection shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development. The approved scheme shall be implemented prior to the first occupation of any dwelling. Reason: To ensure adequate waste collection in accordance with Policy D10 of the adopted South Oxfordshire Local Plan.

All dwellings must be designed and constructed to attain at least Code level 3 rating in accordance with the Code for Sustainable Homes. Prior to the occupation of any individual dwelling, a post construction review certificate for that dwelling shall be submitted to the Local Planning Authority. Reason: To ensure energy efficiency in accordance with Policy D8 of the adopted South Oxfordshire Local Plan.

That a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hardstandings, and the provision of boundary fencing and screen walling shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policy C9 of the South Oxfordshire Local Plan.

That except insofar as may be otherwise agreed by the Local Planning Authority, all trees, shrubs and hedges on the land be preserved and properly maintained and that in the event of any of the trees dying or being seriously damaged or destroyed, a new tree or equivalent number of trees, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policy C9 of the South Oxfordshire Local Plan.

That development shall not begin until a scheme for the disposal of foul sewage has been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health in accordance with Policy D11 of the South Oxfordshire Local Plan.

No development shall take place until the Local Planning Authority are satisfied that contamination has been sufficiently investigated and any remedial action approved. The site shall then not be occupied until any agreed action is implemented and approved by the Local Planning Authority. i. "The following measures (a-d) shall be undertaken to investigate and remediate any contamination on the site prior to commencement of the development: a) A desk study shall be submitted to and approved in writing by the Local Planning Authority. This study shall be conducted fully in line with the approach indicated in BS 10175: 2001 (Investigation of potentially contaminated sites - code of practice). The study shall include the identification of all previous site uses, potential contaminants that might reasonably be expected given those uses and other relevant information. If contamination is suspected at the site the information obtained must then be used to formulate an initial conceptual model for the site including all potential contaminant sources, pathways and receptors. b) Where contamination is identified as having the potential to be present in a) above, proposals for a site investigation to characterise the site must be submitted to and approved in writing by the Local Planning Authority. This proposal shall be designed having regard to the approved desk study and BS 10175. It should be clear about what information it seeks to obtain and how this will refine the initial conceptual model for the site. c) The approved site investigation referred to on b) above shall be fully implemented and a report submitted to the Local Planning Authority for written approval. The report shall be in line with BS 19175 and detail the works undertaken to characterise the site and contain a refined conceptual model in the light of the results of the investigation. N.B. If the Local Planning Authority is not satisfied that the site has been adequately characterised after the first stage of investigation, further works will be required to clarify any remaining uncertainties. d) Where unacceptable levels of contamination are identified, a remediation scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall incorporate details of the procedures and documentation employed to validate the remediation measures identified in c) above. ii. Prior to occupation of the site, the approved remediation and validation schemes in d) above shall be fully implemented and a report submitted and approved in writing by the Local Planning Authority. Reason: In the interests of public health in accordance with Policy EP8 of the South Oxfordshire Local Plan.

That prior to the commencement of any other development to which this permission relates the means of access between the land and the highway shall be formed, laid out and constructed with 2.4 metres by 70 metres vision splays. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policy T1 of the South Oxfordshire Local Plan.

That the development hereby permitted shall not be occupied until the construction of the estate road serving the development, including footways and verges has been undertaken in accordance with the standard specification of the Highway Authority. Reason: In the interests of highway safety and convenience in accordance with Policy T1 of the South Oxfordshire Local Plan.

That no development shall take place until a professionally competent archaeological organisation, as approved in writing by the Local Planning Authority, has been commissioned to carry out a full watching brief during the period of construction works, The watching brief shall preserve by record any archaeological excavation where necessary and the retrieval of artefactual evidence. Reason: To safeguard the recording and inspection of matters of archaeological importance on the site in accordance with Policy CON12 of the South Oxfordshire Local Plan.

Development shall not commence until surface water drainage details, incorporating sustainable principles and an assessment of the hydrological and hydrogeological context of the development, have been submitted to and approved in writing by the Local Planning Authority. The scheme shall subsequently be implemented in accordance with the approved details prior to the first occupation of the development. Reason: In the interests of public health in accordance with Policy D11 of the South Oxfordshire Local Plan.

That prior to the commencement of the development a noise report in accordance with "BS 4142 (1997), Method for rating industrial noise affecting mixed residential and industrial areas" shall be submitted to and approved in writing by the Local Planning Authority. The report shall include the following information:- Noise levels produced by any possible air conditioning units at the nearest noise sensitive location(s) The rating level of the noise - is it tonal or intermittent? The times of operation of the equipment The background noise level at the nearest noise sensitive location Reason: To ensure satisfactory development in accordance with Policy EP1 of the adopted South Oxfordshire Local Plan.

That working on site shall be restricted to 8am to 6 pm Monday to Friday and 8am to 1pm on a Saturday to manage the noise impact on the surrounding residential properties. Any commercial deliveries outside these hours shall only be with the prior written agreement of the Council. These restriction shall apply during construction works on the whole site and for the operation of the employment use thereafter. Reason: To protect land amenities in accordance with Policy EP1 of the adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of Article 3 of, and Class 1 of Schedule 1 to the Town and Country Planning General Development Order 1977 (or any order revoking and re-enacting that Order), no additional windows shall be inserted in the south east elevation of the employment building and the north east elevation of Plot 8 unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To ensure that the development is not unneighbourly in accordance with Policies E5 and H4 of the adopted South Oxfordshire Local Plan.
