Conditions / Refusal Reasons
That alterations to the former stable/dairy and thresher/cart barn shall be limited to those works specifically referred to in the information submitted with the application, with particular reference to the structural appraisal, other than with the prior planning permission of the Local Planning Authority. Reason: To ensure that the building(s) continue to respect the beauty and distinctiveness of the Chilterns Area of Outstanding Natural Beauty and the character of the countryside in accordance with Policies G2, G4, C1, E8 and TSM3 of the South Oxfordshire Local Plan 2011; and to ensure that alteration to the building do not result in "major reconstruction" which would be contrary to Policy E8 of the South Oxfordshire Local Plan 2011.

That the buildings shall be re-clad and re-roofed using materials removed from the original building and, where this proves insufficient, supplemented by materials which match the colour and profile of the materials removed from the original building. Samples of any newly introduced materials shall be first agreed to in writing by the Local Planning Authority prior to re-cladding and/or re-roofing works commencing. For the avoidance of doubt the Local Planning Authority agrees to the details and specification for widow and door joinery and rainwater goods submitted with the application. Reason: To ensure that the building(s) continue to respect the beauty and distinctiveness of the Chilterns Area of Outstanding Natural Beauty and the character of the countryside in accordance with Policies G2, G4, C1, E8 and TSM3 of the South Oxfordshire Local Plan 2011; and to ensure that alteration to the building do not result in "substantial reconstruction" which would be contrary to Policy E8 of the South Oxfordshire Local Plan 2011.

That the residential unit to be provided within the barn shall not be occupied other than for the purposes of holiday accommodation and shall not be let to the same persons for more than 28 days in any calendar year. Reason: The creation of a separate residential unit would conflict with Policies G3, H6 and E8 of the adopted South Oxfordshire Local Plan 2011.

That the residential unit to be provided within the stable building shall be occupied as a single dwelling, either for staff whose sole employment is at The Black Horse Public House, Checkendon or for the purposes of holiday accommodation which shall not be let to the same persons for more than 28 days in any calendar year. Reason: The creation of a separate residential unit would conflict with Policies G3, H6 and E8 of the adopted South Oxfordshire Local Plan 2011.

That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order) no development within Schedule 2, Parts 1 and 2 of the Order shall be undertaken on the land unless planning permission has been granted by the Local Planning Authority on a formal application submitted for such development. Reason: To protect local amenities in accordance with Policies C2 and E8 of the adopted South Oxfordshire Local Plan 2011.

That the area around the stable and barn buildings shall not be subdivided to provide separate residential curtilages for the residential units hereby permitted. Reason: To protect the rural character and appearance of the area in accordance with Policies G4, C2, E8 and TSM3 of the adopted South Oxfordshire Local Plan 2011.

That notwithstanding the bat survey carried out in May 2006 which did not find any evidence of bat activity in the buildings, if any such activity is discovered during building works all works should cease immediately and not re-commence until the written consent of the Local Planning Authority is received following consultation with English Nature. Reason: To protect any bats that are present in accordance with Policy C8 of the adopted South Oxfordshire Local Plan 2011.

That prior to the fitting out and occupation of the buildings a phased contaminated land risk assessment shall be carried out by a competent person in accordance with current government and Environment Agency Guidance and Approved Codes of Practice. Each phase shall be submitted in writing and approved by the Local Planning Authority. Phase 1 shall incorporate a desk study and site walk over to identify all potential contaminative uses on the site and to inform the conceptual site model. If potential contamination is identified then Phase 2 shall be undertaken. Phase 2 shall include a comprehensive intrusive investigation in order to characterise the type, nature and extent of contamination present, the risk to receptors and to inform the remediation strategy proposals. If significant contamination is found then Phase 3 shall be undertaken. Phase 3 requires production of a remediation and/or monitoring scheme to ensure the site is rendered suitable for its proposed use. The remediation shall be carried out in accordance with an approved scheme and no development shall be occupied until all approved remediation works have been carried out and a full validation report has been submitted to and approved to the satisfaction of the Local Planning Authority. In the event that gas protection is required, all such measures shall be implemented in full and confirmation of satisfactory installation obtained in writing from a Building Control Regulator. Reason: To ensure that the proposed development does not result in harm to human health and the wider environment in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.

The developer shall draw to the attention of the Local Planning Authority the presence of any unsuspected contamination encountered during the development. In the event of contamination to land and/or water being encountered, no development shall continue until a programme of investigation and/or remedial work to include methods of monitoring and certification of such work undertaken has been submitted and approved in writing by the Local Planning Authority. None of the development shall be occupied until the approved remedial works, monitoring and certification of the works have been carried out and a full validation report has been submitted to and approved in writing by the Local Planning Authority. In the event that no significant contamination is encountered, the developer shall provide a written statement to the Local Planning Authority confirming that this was the case, and only after written approval by the Local Planning Authority shall the development be occupied. Reason: To ensure that the proposed development does not result in harm to human health and the wider environment in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.
