Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
No development shall take place until samples of the materials to be used in the construction of the external surfaces and the windows and doors of the building hereby permitted, have been submitted to and approved in writing by the local planning authority. Thereafter the development shall be carried out in accordance with the approved details.
Reason: To ensure that the details of the development are satisfactory in accordance with Policies G2, G6, C1, CON5 and H13 of the adopted South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of Schedule 2 Part 1 Class E of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), no openings other than those expressly authorised by this permission shall be inserted in the building hereby approved without the prior written consent of the Local Planning Authority.
Reason: To ensure a satisfactory external appearance and to safeguard the setting of the adjacent listed buildings in accordance with Policies G2, G6, C1, CON5 and H13 of the adopted South Oxfordshire Local Plan 2011.
Tree protection measures in accordance with the recommendations of BS 5387:2005 (Trees in relation to Construction) shall be put in place prior to the commencement of development to safeguard the Leylandii to the west and the Field Maple to the north of the proposed building and retained for the duration of the development. In the event of any tree or hedge dying or becoming decayed within 5 years of the completion of development, then details of a replacement species shall be submitted to and approved in writing by the Local Planning Authority and implemented within the first planting season or with a programme first agreed with the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory in accordance with Policies G2, C1, C9 and CON5 of the adopted South Oxfordshire Local Plan 2011.
The building hereby permitted shall not be occupied or used at any time other than for purposes incidental to the residential occupation of Cadwell Farm. The first floor area shall not be adapted or used as separate residential accommodation and the parking spaces shall remain in use for the parking of private vehicles only.
Reason: To ensure that the proposed building remains in use for incidental purposes to Cadwell Farm and to avoid future requirements for additional garages in accordance with Policies G2, CON5 and H13 of the adopted South Oxfordshire Local Plan 2011.
