Conditions / Refusal Reasons
The proposed development relates to the construction of two 4 bedroom and four 5 bedroom dwellings. This would be contrary to Policy H7 of the South Oxfordshire Local Plan 2011, which seeks to ensure that any new residential development consisting of two or more dwellings meets the identified housing need for smaller two bedroom dwellings in the district. The failure to address housing need would also be contrary to guidance contained within PPS1: Delivering Sustainable Development, and PPS3: Housing.
The proposed development, due to the siting, size, height, bulk and massing of the dwellings would result in a form of backland development that would fail to respect the established spacious and sylvan semi-rural character and appearance of the site and the surrounding area. Furthermore the application site is located within the Chilterns Area of Outstanding Natural Beauty and the development fails to conserve or protect the natural beauty and the special landscape qualities of the AONB. As such the proposal would be contrary to Policies G1, G2, G6, C1, C2, C4, D1, and H4 of the South Oxfordshire Local Plan 2011 and guidance contained within PPS1: Delivering Sustainable Development, PPS3: Housing, PPS7: Sustainable Development in Rural Areas and the South Oxfordshire Design Guide 2000.
The proposed development, due to the intensification of the access, and the siting, size, bulk and massing of the development proposed in relation to Plots 1 and 2, would cause unacceptable levels of noise and disturbance to the occupiers of Number 64 Whitehouse Road, harmful to their residential amenity. It would also have an overbearing effect on Numbers 64 and 66 Whitehouse Road to the detriment of the living conditions of the occupiers. As a result, the proposal would be contrary to Policies G2, D4 and H4 of the South Oxfordshire Local Plan 2011 and guidance contained within the South Oxfordshire Design Guide 2000.
The proposed development would result in the loss of protected trees, which make an important contribution to the environmental quality and landscape character of the area. In addition insufficient information has been submitted by the applicant to demonstrate that the development would not result in a threat to the long term retention of trees to be retained as part of the development. As a result the proposal fails to accord with Policies G2, G6, C1, C2, C4, C9, D1, and H4 of the South Oxfordshire Local Plan 2011, and guidance contained in the South Oxfordshire Design Guide 2000.
