Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a schedule of materials and finishes for the building. Reason: To ensure that the details of the development are satisfactory and to comply with Policies G6 and E8 of the adopted South Oxfordshire Local Plan 2011.

That the development shall not commence until there has been submitted to and approved in writing a scheme for the parking a 3 cars and the barn shall not be occupied until the parking has been laid out in accordance with the approved drawing. Reason: To ensure that adequate on site parking is provided in accordance Policies D2 and T1 of the adopted South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of Schedule 2 Part 1 of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), the garage shown on plan B/02A shall be retained for the parking of private vehicles only. Reason: To ensure that adequate on site parking is provided in accordance with Policies G2, E8 and T1 of the adopted South Oxfordshire Local Plan 2011.

That to avoid potential harm to bats, the following measures shall be carried out: a) A briefing for all contractors involved in works regarding the potential presence of bats; b) If bats are found during the conversion all works should cease immediately and Natural England should be consulted; and c) Provision of two bat boxes to be erected at the rear face of the converted barn prior to its first occupation or use as ancillary accommodation. Reason: In the interests of safeguarding protected species, in accordance with Policies G2 and C6 of the adopted South Oxfordshire Local Plan 2011.

Not to begin any phase of development until the Local Planning Authority are satisfied that the following measures (a-c) have been undertaken to investigate any contamination in accordance with BS:10175 and BS:5930 and have approved all necessary stages in writing. The site shall then not be occupied until any agreed remediation is implemented and approved by the Local Planning Authority. a) Completion of a desk study by a suitably qualified environmental consultant. The desk study shall include a site walkover, identification of all potential sources of contamination, natural and anthropogenic, and an initial conceptual model. b) If potential contamination is identified in a) then an intrusive site investigation must be undertaken. A refined conceptual site model and appropriate laboratory accreditation will be expected. N.B. If the Local Planning Authority is not satisfied that any contamination has been adequately characterised then further works will be required to clarify the remaining uncertainties. It is therefore recommended that the Local Planning Authority are consulted on site investigation proposals. c) Where unacceptable levels of contamination are identified, a remediation scheme shall be produced. The site shall only be occupied once all approved remediation is completed and validated to the satisfaction of the Local Planning Authority. If contamination is found to be present on the site then no further development shall be carried out until the following measures have been undertaken and approved in writing by the Local Planning Authority. An investigation into the nature and extent of the contamination in line with BS 10175. This report should detail the works undertaken to investigate the nature and extent of the contamination and any measures proposed to remediate the site and validate the works. Following written approval by the Local Planning Authority of any remediation and validation proposals they shall be completed in full and a validation report submitted to and approved in writing by the Local Planning Authority before the development continues. Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use in accordance with Policies G2 and EP8 of the adopted South Oxfordshire Local Plan 2011.

That notwithstanding the provisions of Article 3 of, and Classes A, B and C of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Classes A, B & C of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To protect local amenities in accordance with Policies G2 and E8 of the adopted South Oxfordshire Local Plan 2011.

That the additional living accommodation hereby permitted shall be occupied and used only in connection with and ancillary to the occupation and use of the existing property Fern Cottage as a single dwellinghouse, as specified in the application, and shall not be occupied or used separately therefrom. Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy and would conflict with Policies G2 and H6 of the adopted South Oxfordshire Local Plan 2011.
