Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
Samples of the materials to be used for the external walls, and roofs shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Thereafter the development shall be constructed in accordance with the approved details.
Reason: In the interests of the visual appearance of the site in accordance with Policies G2, G6, D1, and H4 of the South Oxfordshire Local Plan 2011.
The existing hedge on the south west boundary of the application site shall be protected during the construction of the development and shall thereafter be retained.
Reason: To ensure the protection of hedges on and adjacent to the site in accordance with Policy C9 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 or any subsequent revision, no additions or extensions to the dwelling shall be built or ancillary buildings or structures erected within the curtilage, unless permission has been granted by the Local Planning Authority on an application made for the purpose.
Reason: To prevent the overdevelopment of the site and to safeguard the amenities of neighbouring properties in accordance with Policies G2, G6, D1, and H4 of the South Oxfordshire Local Plan 2011.
Prior to the occupation of the dwelling hereby approved, the proposed means of access onto Benton Drive is to be formed, laid out and constructed to the approval of the Highway Authority strictly in accordance with the Highway Authority's specifications and that all ancillary works specified shall be undertaken.
Reason: In the interests of road safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
Prior to the occupation of the dwelling hereby approved the parking area shall be provided in accordance with drawing number 07013-P03 and shall be constructed, laid out, surfaced (bound material), drained and completed, and thereafter shall be retained unobstructed except for the parking and turning of vehicles at all times.
Reason: To regularise the use of the available parking area and to reduce the likelihood of roadside parking in the interests of highway safety in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
The development hereby approved shall not be commenced until foul sewerage details have been submitted to and approved in writing by the Local Planning Authority. The submitted details shall include a survey of the foul drainage system downstream of the site to ensure that it has sufficient capacity to serve the dwelling. Thereafter the foul drainage shall be carried out in accordance with the approved details.
Reason: To prevent pollution in accordance with Policies EP1 and EP7 of the South Oxfordshire Local Plan 2011.
No development shall commence until details of bin storage facilities and arrangements for the collection of waste and recyclable materials have been submitted to and approved in writing by the Local Planning Authority. The dwelling shall not be occupied until the bin storage facilities have been provided in accordance with the approved details.
Reason: To ensure that the details are satisfactory in accordance with Policies T1 and D10 of the South Oxfordshire Local Plan 2011.
Notwithstanding the Town and Country Planning (General Permitted Development) Order 1995 (or any subsequent revision), no additional openings shall be inserted at first floor level in the north east elevation of the dwelling unless otherwise agreed in writing by the Local Planning Authority.
Reason: In the interests of the amenity of the neighbouring property in accordance with Policy H4 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of the development hereby approved details of water and energy conservation measures to be incorporated in the dwelling shall be submitted to and approved in writing by the Local Planning Authority. The dwelling shall not be occupied until the approved conservation measures have been provided. The approved conservation measures shall thereafter be retained.
Reason: In the interests of the conservation and efficient use of energy and water in accordance with Policy D8 of the South Oxfordshire Local Plan 2011.
