Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

Prior to the first occupation of the dwelling hereby approved, the existing buildings as shown on drawing number MOFC 2007 04 shall be demolished and all resultant debris removed from the land. Reason: In the interests of visual amenity in accordance with Policies G2, G6, C2, D1 and H13 of the South Oxfordshire Local Plan 2011

Samples of the materials to be used for the external walls and roofs of the dwelling hereby approved and the new brick walls elsewhere within the site shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: In the interests of the visual appearance of the site in accordance with Policies G2, G6, C2, D1 and H12 of the South Oxfordshire Local Plan 2011.

A scheme for the means of treatment of the hard surfaced areas of the site shall be submitted to and approved in writing by the Local Planning Authority before any development starts on site. No buildings shall be occupied or used before the hard surfaced areas have been constructed in accordance with the approved details, unless otherwise agreed in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the site in accordance with Policies G2, G6, C2, D1 and H12 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the dwelling hereby approved details of any external lighting to be used in the areas around the development shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the dwelling shall not be occupied until the external lighting has been installed in accordance with the approved details, unless otherwise agreed in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the site in accordance with Policies G2, G6, C2, D1 and H12 of the South Oxfordshire Local Plan 2011.

Notwithstanding the details shown on the approved plans, a scheme of fencing and other means of enclosure (including details of the height of the fencing/means of enclosure) shall be submitted to and approved in writing by the Local Planning Authority prior to the occupation of the dwelling hereby approved. The dwelling shall not be occupied before the fencing and other means of enclosure has been constructed in accordance with the approved details, unless otherwise agreed in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the site in accordance with Policies G2, G6, C2, D1 and H12 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of the development hereby approved a plan showing the existing and proposed ground levels and finished floor levels of the dwelling hereby approved shall be submitted to and approved in writing by the Local Planning Authority. Such levels shall be shown in relation to a fixed and known datum point. Thereafter the dwelling shall be constructed in accordance with the approved levels. Reason: In the interests of the visual appearance of the site in accordance with Policies G2, G6, C2, D1 and H12 of the South Oxfordshire Local Plan 2011.

No development or other operations, including demolition, shall commence on site until a scheme for the landscaping of the site has been submitted to and approved in writing by the Local Planning Authority. The details shall include schedules of plants, noting species, plant sizes and proposed numbers/densities, an implementation programme, details of the future management of the woodland, and details of written specifications including cultivation and other operations involving tree, shrub and grass establishment. The scheme shall ensure: a) Completion of the approved landscape scheme within the first planting season following the completion of the development. b) Any trees, shrubs or plants that die or become seriously damaged within five years of the commencement of the development shall be replaced by tress or shrubs of similar size and species to those originally required to be planted. Reason: To ensure the implementation of a satisfactory scheme of landscaping which will in due course help to assimilate the development into the site in accordance with Policies G2, G6, C2, D1 and H13 of the South Oxfordshire Local Plan 2011.

No development or other operations, including demolition, shall commence on site until details of a tree and landscape protection scheme have been submitted to and approved in writing by the Local Planning Authority. The scheme shall include positions and specifications of temporary fencing to be erected and no excavations for services, storage of materials, parking of vehicles, excavation of soils or materials shall take place within the area designated as being protected. The approved tree and landscape protection scheme shall be carried out concurrently with the development of the site. Reason: To ensure the protection of trees on and adjacent to the site in accordance with Policy C9 of the South Oxfordshire Local Plan 2011.

No development or other operations, including demolition, shall commence on site until an arboricultural method statement giving details of construction of the no-dig driveway access (in accordance with arboricultural practice Note 1: Driveways Close to Trees), the new pond and any other works within the root protection areas of the trees must be submitted to and approved in writing by the Local Planning Authority. The approved arboricultural method statement shall be carried out concurrently with the development of the site. Reason: To ensure the protection of trees on and adjacent to the site in accordance with Policy C9 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the dwelling hereby approved, the proposed means of access onto Hook End Lane shall be formed, laid out and constructed to the approval of the Highway Authority strictly in accordance with the Highway Authority's specifications and that all ancillary works specified shall be undertaken. Reason: In the interests of road safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the dwelling hereby approved the existing access onto Hook End Lane shall be permanently stopped up by the means of reinstatement of the public highway verge to the approval of the Highway Authority and thereafter shall not be used by any vehicular traffic whatsoever. Reason: In the interests of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

No development shall commence until the Local Planning Authority are satisfied that the following measures (a-c) have been undertaken to investigate any contamination in accordance with BS:10175 and BS:5930 and have approved all necessary stages in writing. The development shall then not be occupied until any agreed remediation is implemented and approved by the Local Planning Authority. a) Completion of a desk study by a suitably qualified environmental consultant. The desk study shall include a site walkover, indentification of all potential sources of contamination, natural and anthropogenic, and an initial conceptual model. b) If potential contamination is identified in a) then an intrusive site investigation must be undertaken. A refined conceptual site model and appropriate laboratory accreditation will be expected. If the Local Planning Authority is not satisfied that any contamination has been adequately characterised then further works will be required to clarify the remaining uncertainties. c) Where unacceptable levels of contamination are identified, a remediation scheme shall be produced. The site shall only be occupied once all approved remediation is completed and validated to the satisfaction of the Local Planning Authority. Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.

If contamination is found to be present on the site, then no further development shall be carried out until the following measures have been undertaken and approved in writing by the Local Planning Authority. An investigation into the nature and extent of the contamination in line with BS:10175. This report should detail the works undertaken to investigate the nature and extent of the contamination and any measures proposed to remediate the site and validate the works. Following written approval by the Local Planning Authority of any remediation and validation proposals they shall be completed in full and a validation report shall be submitted to and approved in writing by the Local Planning Authority before the development continued. Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 or any subsequent revision, no additions or extensions to the dwelling shall be built or ancillary buildings or structures erected within the curtilage, unless permission has been granted by the Local Planning Authority on an application made for the purpose. Reason: To prevent the overdevelopment of the site and to safeguard the character and appearance of the area in accordance with Policies G2, G6, C2, D1, and H12 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of the development hereby approved details of water and energy conservation measures to be incorporated in the dwelling shall be submitted to and approved in writing by the Local Planning Authority. The dwelling shall not be occupied until the approved conservation measures have been provided. The approved conservation measures shall thereafter be retained. Reason: In the interests of the conservation and efficient use of energy and water in accordance with Policy D8 of the South Oxfordshire Local Plan 2011.
