Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

No development shall take place until samples of the materials to be used in the construction of the external surfaces of the building hereby permitted have been submitted to and approved in writing by the local planning authority. Development shall be carried out in accordance with the approved details. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G2, G6 and E5 of the South Oxfordshire Local Plan 2011.

The development to which this permission relates shall not be exercised in addition to or in combination with any part of the development permitted under reference P02/S0317. Accordingly, this permission shall be alternative to the previous permission so that either, but not both, may be implemented. Reason: To prevent an inappropriate development of the site by the implementation or partial implementation of both permissions in accordance with Policies G2, G6 and E5 of the South Oxfordshire Local Plan 2011.

A scheme for cycle parking shall be provided in accordance with a programme of works to be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development and thereafter retained as approved. Reason: In order to promote sustainable transport in accordance with Policies G2, E5 and T1 of the South Oxfordshire Local Plan 2011.

The access alterations including the relocation of the substation shall be undertaken as approved in accordance with a programme of works to be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development and thereafter retained as approved. Reason: In the interests of highway safety in accordance with Policies G2, E5 and T1 of the South Oxfordshire Local Plan 2011.

The parking, loading and manoeuvring areas shall be set out as approved in accordance with a programme of works to be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development and thereafter retained as approved. Reason: In the interests of highway safety in accordance with Policies G2, E5 and T1 of the South Oxfordshire Local Plan 2011.

A revised landscaping scheme shall be submitted and approved in writing by the Local Planning Authority prior to the commencement of development and thereafter implemented as approved. Reason: To safeguard the character of the area in accordance with Policies G2, C9 and E5 of the South Oxfordshire Local Plan 2011.

Flood storage compensation works shall be undertaken in accordance with Revision A of the JPP Flood Risk Assessment received 4 June 2007. Reason: To prevent the increased risk of flooding due to impedance of flood flows and reduction of flood water storage capacity in accordance with Policies G2, EP5 and E5 of the South Oxfordshire Local Plan 2011.

The warehouse shall be constructed with apertures in the walls and gaps under the entrances from ground level up to the design flood water level (36.78m aODN) to allow free entry and egress of flood water. Reason: To prevent the increased risk of flooding due to impedance of flood flows and reduction of flood water storage capacity in accordance with Policies G2, EP5 and E5 of the South Oxfordshire Local Plan 2011.

No spoil or materials other than those detailed in the approved Flood Risk Assessment shall be deposited or stored on that part of the site lying within the area of land liable to flood. Reason: To prevent the increased risk of flooding due to impedance of flood flows and reduction of flood water storage capacity in accordance with Policies G2, EP5 and E5 of the South Oxfordshire Local Plan 2011.

Any walls or fencing constructed within or around the site shall be designed to be permeable to flood water. Reason: To prevent obstruction to the flow and storage of flood water, with a consequent increased risk of flooding in accordance with Policies G2, EP5 and E5 of the South Oxfordshire Local Plan 2011.

Prior to works commencing, details of surface water drainage shall be submitted to and approved in writing by the Local Planning Authority. The drainage system shall be constructed in accordance with the approved plans. Reason: To protect the water quality discharging into controlled waters in accordance with Policies G2, EP6, EP7 and E5 of the South Oxfordshire Local Plan 2011.

No development shall take place until the LPA are satisfied that the following measures (a-c) have been undertaken to investigate and remediate any contamination and have approved all necessary stages in writing. The site shall then not be occupied until any agreed action is implemented and approved by the LPA. a) Completion of a desk study by a suitably qualified person. The Desk Study shall be completed in accordance with BS 10175 2001 and include a site walkover, identification of all potentially contaminative site uses and in initial conceptual model. b) If potential contamination is identified in a) then an intrusive site investigation must be completed. This investigation must be undertaken in accordance with BS 10175 and having regard to the approved desk study. A report shall be produced detailing the works undertaken to characterise the site and contain a refined conceptual model in the light of the results of the investigation. All chemical analysis shall be undertaken by MCERTS accredited laboratories. N.B. If the LPA is not satisfied that the site has been adequately characterised after the first stage of investigation, further works will be required to clarify any remaining uncertainties. It is therefore recommended that the LPA are consulted on the site investigation proposal before completion of the works. c) Where unacceptable levels of contamination are identified, a remediation scheme shall be produced. The scheme shall incorporate details of the procedures and documentation employed to validate the remediation. The approved remediation scheme shall then be implemented in full and the report detailing the works approved by the LPA in writing before occupation of the site. If contamination is found to be present on the site then no further development shall be carried out until the following measures have been undertaken and approved in writing by the LPA. An investigation into the nature and extent of the contamination in line with BS 10175: 2001 (Investigation of potentially contaminated sites - code of practice). This report should detail the works undertaken to investigate the nature and extent of the contamination and the measures proposed to remediate the site and validate the works. Following written approval by the LPA of the remediation and validation proposals they shall be completed in full and a validation report submitted to and approved in writing by the LPA before the development is occupied. Reason To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use in accordance with Policies G2, EP7, EP8 and E5 of the South Oxfordshire Local Plan 2011.

That with the exception of fork lift trucks and delivery vehicles, no plant or machinery shall be operated or repaired in the open.

That the area occupied by the trade counter shall be limited to the area shown on the approved plan TPRDW/4K-B01B. No other part of the building or site shall be used for this purpose. Reason: To safeguard the character and appearance of the area, the residential amenity of neighbours and in the interest of highway safety in accordance with Policies G2, EP2, E5 and T1 of the South Oxfordshire Local Plan 2011.

The hours of operation shall be limited to 7:30am to 5pm Mondays to Fridays, 8am to 12pm Saturdays and no trade on Sundays and Bank Holidays.
