Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That prior to the commencement of the development full joinery details for the new window and door at scale 1:10 (elevation and sections) and 1:1 of glazing bars shall be submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory in accordance with Policy CON7 of the Council's Adopted South Oxfordshire Local Plan.

That the area of the ground floor to be used a chocalaterie A3 use shall be restricted to the areas shown on the proposed floor plan accompanying the application. Reason: The change of use of the whole of the ground floor of the building to A3 use would be contrary to Policy TC8 of the Council's Adopted South Oxfordshire Local Plan which seeks to protect retail use in primary shopping frontages.

That the A3 use shall be operated ancillary to and in connection with the remaineder of the building as a shop. Reason: It's use as a separate café would be contrary to Policy TC8 of the Council's Adopted South Oxfordshire Local Plan.

That the use of the premises as a whole shall be restricted to the hours of Monday to Saturday 09:00 to 18:00, and Sundays and Bank Holidays 10:00 to 17:30. Reason: To protect the amenity of adjoining properties in accordance with Policies G2 and EP2 of the Council's Adopted South Oxfordshire Local Plan.

That within 28 days form the date of this permission, full details of the proposed air conditioning unit shall be submitted to and approved in writing by the Local Planning Authority. The rated noise level from the air conditioning unit shall not exceed the background noise level. The rating and measurements shall be in full accordance with BS:4142 1997 method for rating industrial noise affecting mixed residential and industrial areas. The air conditioning unit shall be installed in accordance with the approved details and shall thereafter be so retained. Reason: To protect the amenity of adjoining properties in accordance with Policies G2 and EP2 of the Council's Adopted South Oxfordshire Local Plan.
