Conditions / Refusal Reasons
The development shall be carried out strictly in accordance with the particulars of the development, plans and specifications contained in the application except as modified by conditions of this permission.
Reason: To ensure that the development is carried out as proposed.
The development to which this permission relates shall be begun not later than the expiration of three years beginning with the date of this permission.
Reason: To comply with Section 91 of the Town and Country Planning Act 1990. (MWLP PE19).
No construction works shall take place except between the hours of 07.30 to 18.00 Mondays to Fridays and 08.00 to 13.00 on Saturdays. No construction works shall take place on Sundays or Bank Holidays.
Reason: To protect the amenities of local residents. (MWLP PE18).
All plant, machinery and equipment (i.e. pumps) to be used by reason of the granting of this permission shall be so installed, maintained and operated so as to prevent the transmission of noise and vibration into any premises either attached to, or in the vicinity, of the premises to which the application refers.
Reason: To protect the occupants of nearby residential properties from noise disturbance (MWLP PE18).
Upon the completion of the development, any external lighting scheme on the site shall be designed and installed so the main beam angle is not directed towards any potential observer and at an angle greater than 70 degrees. This scheme shall also ensure that light trespass into the windows of any light sensitive premises shall not have a Vertical Illuminance greater than 5 Lux (in accordance with the Institute of Lighting Engineers Guidance Notes for the Reduction of Obtrusive Light GN01).
Reason: To protect the appearance of the area, the environment and wildlife, and local residents from light pollution (OMWLP PE18).
No development shall commence until a scheme for the planting of the new hedgerow indicated on plan 93JF-A1-04009-EX D, has been submitted to and approved in writing by the Waste Planning Authority. The scheme shall comprise native species to match the existing. The scheme shall be implemented as approved during the first planting season following the commencement of the works and thereafter maintained in accordance with the approved scheme. In the event that any of the trees or shrubs so planted are seriously damaged or destroyed within 5 years of the completion of the development a new tree or shrub, or the equivalent number of trees or shrubs, shall be planted the following planting season and properly maintained. The species and positions of any replacement trees or shrubs should match the tree or shrub that they replace.
Reason: In the interests of amenity and wildlife conservation. (MWLP PE18).
