Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That samples of the materials to be used for the external walls and roof of the gazebo shall be submitted to and approved in writing by the Local Planning Authority before any development commences.
Reason: To safeguard the character and appearance of the locality in accordance with Policies CON5, CON7 and C2 of the adopted South Oxfordshire Local Plan 2011.
That a sample of the materials to be used for the stone paving of the terrace
shall be submitted to and approved in writing by the Local Planning Authority before any development commences.

That no development shall take place within the application area until the applicant, or their agents or successors in title, has secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation which shall first have been submitted to and approved by the Local Planning Authority. The stripping of topsoil and other invasive landscaping shall be carried out under archaeological supervision and where necessary shall be followed by an appropriate level of archaeological excavation and recording. The programme of work shall include all processing, research and analysis necessary to produce an accessible and useable archive and a full report for publication. The work shall be carried out by a professional archaeological organisation acceptable to the Local Planning Authority.
Reason: To safeguard the identification and recording of archaeologically significant remains on the site in accordance with Policy CON13 of the adopted South Oxfordshire Local Plan 2011.
That the development site shall only be accessed via the driveway and existing hardstanding areas currently associated with The Smithy or via the temporary access route shown on Drawing No. 178-29 and via no other route whatsoever. The access routes shall be marked out with temporary exclusion fencing to prevent the movement of machinery or personnel outside of these areas. No activity shall take place or spoil be deposited within the area to the north of the temporary access route marked on Drawing No. 178-29.
Reason: To prevent damage and disruption to the habitat of a fully protected species which may be present on the site in accordance with Policy C8 of the adopted South Oxfordshire Local Plan 2011.
That the movement of machinery and construction traffic shall be restricted to the temporary access track on Drawing No. 178-29, which shall be marked by exclusion fencing. The area to the south of the track shall only be used for the storage and stockpiling of spoil and for no other materials whatsoever. Root Protection Areas for the trees to be retained within this part of the site shall be marked with temporary protective fencing based on a 12 times stem diameter. Appropriate arboricultural supervision of ANY works within the Root Protection Areas shall be undertaken and continuing compliance with the protective measures specified shall be monitored. The requirement for any departure from such measures should be reported to and approved in writing by the Local Planning Authority.
Reason: To ensure the protection of important trees in accordance with Policy C9 of the adopted South Oxfordshire Local Plan 2011.
That following completion of the development all temporary fencing shall be removed from the site and the land affected by the temporary access track shall be restored to its original state.
Reason: To safeguard the character and appearance of the locality in accordance with Policies CON5, CON7 and C2 of the adopted South Oxfordshire Local Plan 2011.
That clean, uncontaminated rock, subsoil, brick rubble, crushed concrete and ceramic only shall be permitted as infill material.
Reason: To prevent pollution of controlled waters in accordance with Policies EP6 and EP7 of the adopted South Oxfordshire local Plan 2011.
That no soakaways shall be constructed such that they penetrate the water table and they shall not in any event exceed 2 metres in depth below the exiting ground level.
Reason: To prevent the pollution of groundwater in accordance with Policy EP7 of the adopted South Oxfordshire Local Plan 2011.
That no soakaways shall be constructed in contaminated ground.
Reason: To prevent the pollution of groundwater in accordance with Policy EP7 of the adopted South Oxfordshire Local Plan 2011.
That if, during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing by the Local Planning Authority) shall be carried out until a Method Statement has been submitted to and approved in writing by the Local Planning Authority. This Method Statement must detail how this unsuspected contamination shall be dealt with.
Reason: To prevent the pollution of controlled waters in accordance with Policies EP6 and EP7 of the adopted South Oxfordshire Local Plan 2011.
