Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced.
Reason: To safeguard the character of the area in accordance with Policy H5 of the adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no windows shall be constructed in the north west elevation (side facing Powell Close properties) of the dwelling other than those expressly authorised by this permission.
Reason: To ensure that the development is not unneighbourly in accordance with Policy H5 of the adopted South Oxfordshire Local Plan.
That the dwelling shall be constructed on the slab levels shown on drawing no 191/P24.
Reason: To safeguard the character of the area in accordance with Policy H5 of the adopted South Oxfordshire Local Plan.
That the garage and studio hereby permitted shall be occupied and used only in connection with and ancillary to the occupation and use of Green Bank as a single dwellinghouse, as specified in the application, and shall not be occupied or used separately therefrom.
Reason: As the separate occupation of the accommodation would be contrary to the Council's housing policies in accordance with Policy H6 of the adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of Article 3 of, and Classes A, B or E of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order) no development within those classes shall take place on the site unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof.
Reason: To protect the character of the area and to ensure the development is not unneighbourly in accordance with Policies GB2 and H5 of the adopted South Oxfordshire Local Plan.
That, there shall be no raising of levels on the site as a result of the excavation works for the house and terrace. The spoil generated shall be removed from the site prior to the occupation of the replacement dwelling.
Reason: To safeguard the character of the area in accordance with Policy GB4 of the adopted South Oxfordshire Local Plan.
That the line of the terrace wall shall be realigned to ensure that a satisfactory protection zone can be provided for the walnut tree to the south west of the dwelling. The protection zone shall be that recommended in BS 5837: Trees in relation to Construction 2005 and details of the realignment shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development on the site. Adequate protection measures for the trees to the south west of the house in accordance with BS 5837 shall be put in place prior to any works on the site including any demolition and shall remain in place during the course of construction.
Reason: To safeguard important trees on the site in accordance with Policy C9 of the adopted South Oxfordshire Local Plan.
That a scheme for the landscaping of the site, including the planting of live trees and shrubs and the treatment of the access road, hardstandings and the terrace shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policy C1 of the adopted South Oxfordshire Local Plan.
