Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

Samples of hand made clay tiles and natural stone shall be submitted and approved in writing prior to the commencement of development. Reason: To ensure that the details of the development are satisfactory and to comply with Policies G2 and CON7 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of development the design and materials for the chimney stacks and pots shall be submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory and to comply with Policies G2 and CON7 of the adopted South Oxfordshire Local Plan.

That the rainwater goods should be cast iron. Reason: To ensure that the details of the development are satisfactory and to comply with Policies G2 and CON7 of the adopted South Oxfordshire Local Plan.

That development shall not begin until a detailed specification of the type, design and external finish of all windows and external doors at a scale of 1:10 (elevations) and 1:5 (sections) has been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory and to comply with Policies G2 and CON7 of the adopted South Oxfordshire Local Plan.

Lime mortar shall be used in the construction of the dwelling without the addition of cement. Reason: To ensure that the details of the development are satisfactory and to comply with Policies G2 and CON7 of the adopted South Oxfordshire Local Plan.

Details of external ventilation and flue outlets shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. Reason: To ensure that the details of the development are satisfactory and to comply with Policies G2 and CON7 of the adopted South Oxfordshire Local Plan.

A scheme for the hard and soft landscaping of the site, which should include details for the planting of live trees and shrubs and for the treatment of the driveway and provision of boundary treatments shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. Reason: To help assimilate the development into surroundings and to comply with Policies G2 and C9 of the adopted South Oxfordshire Local Plan.

The approved scheme shall be implemented within 12 months of the commencement of the development hereby permitted. In the event of any trees or shrubs so planted dying or being seriously damaged, destroyed or diseased within 3 years of the completion of the development, they shall be replaced by an equivalent number of trees and shrubs of the same species in the next planting season following their demise, unless otherwise previously agreed to in writing by the Local Planning Authority. Reason: To help to assimilate the development into the surrounding area and to comply with Policies G2 and C9 of the adopted South Oxfordshire Local Plan.

That prior to the occupation of the proposed dwelling the proposed means of access onto Mulberry Drive is to formed, laid out and constructed to the approval of the Highway Authority strictly in accordance with the highway authority's specifications and that all ancillary works specified shall be undertaken. Reason: In the interests of highway safety and convenience and to comply with Policies G2 and T1 of the adopted South Oxfordshire Local Plan.

Before the proposed dwelling is first occupied the parking and manoeuvring areas shall be provided in accordance with the plan (0405/13) hereby approved and shall be constructed, laid out, surfaced (bound material) drained and completed, and shall be retained and unobstructed except for the parking of vehicles at all times. Reason: In the interests of highway safety and convenience and to comply with Policies G2 and T1 of the adopted South Oxfordshire Local Plan.

That no surface water from the development shall be discharged onto the adjoining highway, and a scheme to prevent this occurrence shall be submitted to and approved in writing by the Local Planning Authority and constructed prior to the commencement of building operations. Reason: In the interests of highway safety and convenience and to comply with Policies G2 and T1 of the adopted South Oxfordshire Local Plan.

Prior to the first use of the new vehicular access onto Mulberry Drive, the existing access to the site from Farm Close Lane shall be permanently closed to vehicular traffic and retained for pedestrian use only thereafter. The verge/footway crossing shall be reinstated where necessary, to the satisfaction of the Local Planning Authority and maintained as such in perpetuity. Reason: To ensure satisfactory access arrangements in the interests of highway safety and to comply with Policy T1 of the adopted South Oxfordshire Local Plan.

No development shall take place until the Local Planning Authority are satisfied that the following measures (a-c) have been undertaken to investigate and remediate any contamination and have approved all necessary stages in writing. The site shall then not be occupied until any agreed action is implemented and approved by the Local Planning Authority. a) Completion of a desk study by a suitably qualified person. The Desk Study shall be completed in accordance with BS 10175 2001 and include a site walkover, identification of all potentially contaminative site uses and an initial conceptual model. b) If potential contamination is identified in a) then an intrusive site investigation must be completed. This investigation must be undertaken in accordance with BS 10175 and having regard to the approved desk study. A report shall be produced detailing the works undertaken to characterise the site and contain a refined conceptual model in the light of the results of the investigation. All chemical analysis shall be undertaken by MCERTS accredited laboratories. N.B If the LPA is not satisfied that the site has been adequately characterised after the first stage of investigation, further works will be required to clarify any remaining uncertainties. It is therefore recommended that the Local Planning Authority are consulted on the site investigation proposal before completion of the works. c) Where unacceptable levels of contamination are identified, a remediation scheme shall be produced. The scheme shall incorporate details of the procedures and documentation employed to validate the remediation . The approved remediation scheme shall then be implemented in full and the report detailing the works approved by the Local Planning Authority in writing before occupation of the site. Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use and to comply with Policy EP1 of the adopted South Oxfordshire Local Plan.

In connection with the implementation of this permission no demolition and construction works shall take place outside the hours of 07:30 and 18:00 Mondays to Fridays and 8am to 1pm on Saturdays. Works shall not take place at all on Sundays or Bank Holidays without the prior written approval of the Local Planning Authority. Reason: To protect the occupants of nearby residential properties from noise and dust disturbance during the development of the site in accordance with Policy EP1 of the adopted South Oxfordshire Local Plan.

Upon completion of the development, any external lighting shall be designed and installed so the main beam angle is not directed towards any potential observer and is not at an angle greater than 70 degrees from the vertical . This scheme shall also ensure that light trespass into the windows of any light sensitive premises shall not have a Vertical Illuminous greater than 5 Lux ( in accordance with the Institution of Lighting Engineers Guidance Notes for the Reduction of Obtrusive Light GN01) To protect the appearance of the area, the environment and wildlife, and local residents from light pollution and to comply with policy EP3 of the adopted South Oxfordshire Local Plan.

That the bathroom window in the front elevation facing Farm Close Lane shall be obscure glazed prior to the first occupation of the premises and shall thereafter be retained as such. Reason: To ensure that the development is not unneighbourly and to comply with Policy H4 of the adopted South Oxfordshire Local Plan.
