Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That all plant and machinery shall be removed from the site and the site shall be left in a tidy and orderly state within 18 months of the first operation of the power plant hereby permitted. Reason: In view of the temporary nature of the development in accordance with Policy G2 of the adopted South Oxfordshire Local Plan.

That the existing trees and hedges on the land shall be protected whilst development operations are in progress, in accordance with a scheme to be first agreed in writing with the Local Planning Authority and to be implemented prior to the commencement of the development. Reason: To help to assimilate the development into its surroundings in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

That surface water shall not be disposed of other than in accordance with a detailed surface water drainage scheme which shall first have been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health in accordance with Policy G17 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the deposited plan reference 06-1883-04 and all ancillary works therein specified shall be undertaken strictly in accordance with the said deposited plan. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That before any of the development hereby permitted is occupied, the parking and turning spaces shown on the approved plan shall be constructed and such spaces shall thereafter be kept permanently available for the use of residents, employees and visitors to the site. Reason: In the interests of highway safety and convenience in accordance with Policy G11 of the adopted South Oxfordshire Local Plan.

No development approved by this planning permission shall be commenced until: a) A desktop study shall be carried out which shall include the identification of previous site uses, potential contaminations that might reasonably be expected given those uses and other relevant information; and using this information a diagrammatical representation (conceptual model) for the site of all potential contaminant sources, pathways and receptors has been produced. b) A site investigation shall be designated for the site using the information obtained from the desktop study and any conceptual model. This shall be submitted to and approved in writing by the Planning Authority before the investigation is carried out on the site. The investigation shall be comprehensive enough to enable: - a risk assessment to be undertaken relating to groundwater and surface waters associated on and off the site that may be affected; - refinement of the conceptual model; and - the development of a method statement detailing the remediation requirements. c) The site investigation has been undertaken in accordance with details approved by the Planning Authority and a risk assessment has been undertaken. d) A method statement detailing the remediation requirements, including measures to minimise the impact on ground and surface waters, using the information obtained from the site investigation, has been submitted to and approved in writing by the Planning Authority. Reason: To prevent pollution of the water environment in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

The construction of storage facilities for oils, fuels or chemicals shall be carried out in accordance with details submitted to and approved in writing by the Local Planning Authority before development is commenced. Reason: To prevent pollution of the water environment in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

The construction of the fuel delivery area drainage system shall be carried out in accordance with details submitted to and approved in writing by the Local Planning Authority before the development commences. Reason: To prevent pollution of the water environment in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

No soakways shall be constructed such that they penetrate the water table, and they shall not in any event exceed 1 metre in depth below existing ground level. Reason: To prevent pollution of groundwater in accordance with Policy G17 of the adopted South Oxfordshire Local Plan.

During construction no solid matter shall be stored within 10 metres of the banks of the Moor Ditch and thereafter no storage of materials shall be permitted in this area. Reason: To prevent solid materials from entering the Moor Ditch and causing pollution in accordance with Policy G16 of the adopted South Oxfordshire Local Plan.
