Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That prior to the first use of the proposed new access to serve Lobbersdown Farm, the proposed means of access onto the Rycote Lane (A329) is to be formed, laid out and constructed to the approval of the Highway Authority strictly in accordance with the highway authority's specifications and that all ancillary works specified shall be undertaken.
Reason: In the interests of highway safety and convenience and to accord with Policies G2 and T1 of the adopted South Oxfordshire Local Plan.
Prior to the first use of the proposed new access to serve Lobbersdown Farm, the proposed vision splay shall be provided in accordance with the plan (06040-P02) hereby approved; this vision splay shall not be obstructed by any object, structure, planting or other material.
Reason: In the interests of highway safety and convenience and to accord with Policies G2 and T1 of the adopted South Oxfordshire Local Plan.
Before the proposed new access is first used, the existing access onto Rycote Road (A329) shall be permanently stopped up by the means of the reinstatement of the highway verge with full face kerbing (and fence/hedging) to the approval of the Highway Authority and thereafter shall not be used by any vehicular traffic whatsoever.
Reason: In the interests of highway safety and convenience and in accordance with Policies G2 and T1 of the adopted South Oxfordshire Local Plan.
Details of the drainage of the proposed access track should be forwarded for approval as should any details of culverting of existing watercourses which might result from the proposal.
Reason: In the interests of public health and in accordance with Policies G2 and EP6 of the adopted South Oxfordshire Local Plan.
That details of surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing.
Reason: In the interests of public health in accordance with Policy EP6 of the South Oxfordshire Local Plan.
A planting scheme which should include details of the type and size of the trees and shrubs to be planted shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted.
Reason: To help to assimilate the development into its surroundings and to comply with Policies G2 and C4 of the adopted South Oxfordshire Local Plan.
The approved scheme shall be implemented within 12 months of the commencement of development hereby permitted. In the event of any of the trees or shrubs planted dying or being seriously damaged, destroyed or diseased within 3 years of the completion of the development, they shall be replaced by an equivalent number of trees or shrubs of the same species in the next planting season following their demise, unless otherwise previously agreed to in writing by the Local Planning Authority.
Reason: To help assimilate the development into its surroundings and in accordance with Policies G2 and C4 of the adopted South Oxfordshire Local Plan.
