The approval of the details of the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Local Planning Authority in writing before any development is commenced. Reason: As the application is in outline only and not accompanied by detailed plans. Related application(s): P09/W0438/DIS

That application for approval of the reserved matters shall be made to the Local Planning Authority before the expiration of 3 years from the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. Related application(s): P09/W0438/DIS

That the development to which this permission relates must be begun not later than the expiration of 2 years from the final approval of the reserved matters or in the case of approval on different dates the final approval of the last such matter to be approved. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P09/W0438/DIS

That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a schedule of materials and finishes for the external walls and roofs of the buildings. Reason: To safeguard the character and appearance of the Brightwell-cum-Sotwell Conservation Area in accordance with Policies G2 and CON7 of the South Oxfordshire Local Plan.

That notwithstanding the provisions of Article 3 of, and Class A of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no additional windows to those shown on the submitted plans shall be inserted in the side elevations of the houses, unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To ensure that the development is not unneighbourly in accordance with Policy D4 of the South Oxfordshire Local Plan.

That development shall not begin until a detailed specification of the type, design and external finish of all windows and external doors has been submitted to and approved in writing by the Local Planning Authority. Reason: To safeguard the character and appearance of the Brightwell-cum-Sotwell Conservation Area in accordance with Policies G8 and CON10 of the South Oxfordshire Local Plan.

That except insofar as may be otherwise agreed in writing by the Local Planning Authority, all trees, shrubs and hedges on the land shall be retained and protected during the course of the development and for a period of five years following the completion of the development. Any trees, shrubs or plants which within that period die, are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason: To safeguard trees and hedges which are visually important in accordance with Policies G2 and CON7 of the South Oxfordshire Local Plan.

That the existing trees and hedges on the land shall be protected whilst development operations are in progress, in accordance with a scheme to be first agreed in writing with the Local Planning Authority and to be implemented prior to the commencement of the development. Reason: To safeguard trees and hedges which are visually important in accordance with Policy G2 of the South Oxfordshire Local Plan.

That prior to the commencement of any other development to which this permission relates all means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the deposited plan reference 0274-P02 attached to P03/W0387/O and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification and deposited plan. Reason: In the interests of highway safety and convenience in accordance with Policy T2 of the South Oxfordshire Local Plan.

That the dwellings shall not be occupied until a turning space has been constructed within the curtilage so that motor vehicles may enter, turn round and leave in a forward direction. Reason: In the interests of highway safety and convenience in accordance with Policy T2 of the South Oxfordshire Local Plan.

That the parking provision shall be as shown on the deposited drawing, reference 0274-P02 attached to P03/W0387/O all constructed, surfaced and laid out, retained and maintained to the satisfaction of the Local Planning Authority. Reason: In the interests of highway safety and convenience in accordance with Policy T2 of the South Oxfordshire Local Plan.

That all waste material from the demolition of the bungalow shall be removed from the site prior to the construction of the two dwellings. Reason: To safeguard the character and appearance of the Brightwell-cum-Sotwell Conservation Area in accordance with Policy CON6 of the adopted South Oxfordshire Local Plan.

That notwithstanding the requirements of Condition 7 on planning permission P03/W0387/O a planting scheme for new trees and hedging shall be prepared, submitted to and agreed in writing by the Local Planning Authority before the existing trees are removed. The agreed scheme shall be implemented during the first available planting season following the removal of the existing trees. Reason: To safeguard the character of the area in accordance with Policy G2 of the South Oxfordshire Local Plan.

Development shall not commence on site until written approval has been granted by the Local Planning Authority to plans detailing the slab level(s) of the building(s) hereby permitted relative to existing ground level, and the development shall only proceed strictly in accordance with the details so approved. Reason: To ensure that the development is not unneighbourly or intrusive and in accordance with Policy D4 of the South Oxfordshire Local Plan.

That no development shall take place until the Local Planning Authority are satisfied that the following measures (a-c) have been undertaken to investigate and remediate any contamination and have approved all necessary stages in writing. The site shall then not be occupied until any agreed action is implemented and approved by the Local Planning Authority. a) Completion of a desk study by a suitably qualified person. The Desk Study shall be completed in accordance with BS 10175 2011 and include a site walkover, identification of all potentially contaminative site uses and in initial conceptual model. b) If potential contamination is identified in a) then an intrusive site investigation must be completed. This investigation must be undertaken in accordance with BS 10175 and having regard to the approved desk study. A report shall be produced detailing the works undertaken to characterise the site and contain a refined conceptual model in the light of the results of the investigation. All chemical analysis shall be undertaken by MCERTS accredited laboratories. N.B. If the Local Planning Authority is not satisfied that the site has been adequately characterised after the first stage of investigation, further works will be required to clarify any remaining uncertainties. It is therefore recommended that the Local Planning Authority are consulted on the site investigation proposal before completion of the works. c) Where unacceptable levels of contamination are identified, a remediation scheme shall be produced. The scheme shall incorporate details of the procedures and documentation employed to validate the remediation. The approved remediation scheme shall then be implemented in full and the report detailing the works approved by the Local Planning Authority in writing before occupation of the site. Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use and in accordance with Policy EP8 of the South Oxfordshire Local Plan.

That if contamination is found to be present on the site then no further development shall be carried out until the following measures have been undertaken and approved in writing by the Local Planning Authority. An investigation into the nature and extent of the contamination in line with BS 10175: 2001 (Investigation of potentially contaminated sites - code of practice). This report should detail the works undertaken to investigate the nature and extent of the contamination and the measures proposed to remediate the site and validate the works. Following written approval by the Local Planning Authority of the remediation and validation proposals they shall be completed in full and a validation report submitted to and approved in writing by the Local Planning Authority before the development is occupied. Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use and in accordance with Policy EP8 of the South Oxfordshire Local Plan.
