Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That prior to the first use of the new access, the proposed means of access onto Stanton Road (B4027) is to be formed, laid out and constructed to the approval of the Highway Authority strictly in accordance with the Highway Authority's specifications and that all ancillary works specified shall be undertaken. Reason: In the interests of highway safety and convenience in accordance with Policy T1 of the South Oxfordshire Local Plan.

That prior to the first use of the proposed access and at all time thereafter the vegetation between the highway verge and the boundary of the site shall be removed and cut back on the northern side of the access up to the point of junction with the next access on the northern boundary of the site. This vision splay shall not be obstructed by any object, structure, planting or other material. Reason: In the interests of highway safety and convenience in accordance with Policy T1 of the South Oxfordshire Local Plan.

That before the proposed access/driveway is first used, the existing access onto Polecat End Lane shall be stopped up by the means of a barrier, the design and material details of which shall be first agreed in writing with the Local Planning Authority and the public highway verge reinstated to the approval of the Highway Authority and this access shall not thereafter be used by any vehicular traffic other than in an emergency. Reason: In the interests of highway safety and convenience in accordance with Policy T1 of the South Oxfordshire Local Plan.

That prior to the first use of the proposed access the gate at the entrance of the proposed access shall be set back a minimum of 5 metres from the back edge of the carriageway in order to allow for a vehicle to park off the public highway whilst the gates are unlocked. Reason: In the interests of highway safety and convenience in accordance with Policy T1 of the South Oxfordshire Local Plan.

That notwithstanding any indications as to those matters which may have been given in the application, no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a detailed plan showing the realignment section of driveway outside the protection zones of the trees along the frontage of the site onto Stanton Road. Reason: To safeguard trees and hedges which are visually important in accordance with Policy G2 of the South Oxfordshire Local Plan.

That notwithstanding any indications as to those matters which may have been given in the application no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a detailed plan including a section through the site, the treatments including the use of geo grid system and surface finishes for the access and crossover and specification of the location materials and means of construction of temporary protective fencing and/or ground protection in the vicinity of trees to be retained in accordance with the recommendations of BS5837 (2005) Trees in Relation to Construction and details of the timing and duration of its erection. Reason: To safeguard trees and hedges which are visually important in accordance with Policy G2 of the South Oxfordshire Local Plan.

That notwithstanding any indications as to those matters which may have been given in the application no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority full details of the replacement fencing giving details of its height and finishes. Reason: To safeguard the character and appearance of the Forest Hill Conservation Area in accordance with Policy CON7 of the South Oxfordshire Local Plan.

That a scheme for the landscaping of the site, including the planting of live trees, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or equivalent number of trees, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason:To help to assimilate the development into its surroundings in accordance with Policy G2 of the South Oxfordshire Local Plan.
