Demolition of existing Lamb Garage building, except the Castle Street facade. Change of use and erection of 8 town houses and 4 apartments. Conversion of dilapidated Coach House to residential dwelling and erection of a lean-to extension to form bin store. Re-forming access to George Hotel car park and forming of access and car park to the rear of 82 High Street and new access to car park of proposed dwellings(as amended by drawing nos.10321/04f and 06 accompanying letter from Agent dated 2 August 2006 and drawing nos.10321/01g, 02g, 03j and 05f accompanying letter from Agent dated 4 October 2006)
Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That sample of the natural slates and hand made clay tiles to be used for the roofs shall be submitted to and approved in writing by the Local Planning Authority before any development commences.
To ensure that the details of the development are to an acceptable standard to enhance the character and appearance of the Conservation Area in accordance with Policy CON7 of the South Oxfordshire Local Plan.
That development shall not begin until a detailed specification of the type, design and external finish of all windows and external doors has been submitted to and approved in writing by the Local Planning Authority. details of all windows including dormers, rooflights and doors shall be submitted on drawings at a scale of 1:10.
Reason: To ensure that the details of the development are to an acceptable standard to enhance the character and appearance of the Conservation Area in accordance with Policy CON7 of the South Oxfordshire Local Plan.
That the walls shall be constructed using Flemish bond brickwork and samples of the bricks to be used shall be submitted to and approved in writing by the Local Planning Authority before any development commences. A sample panel shall first be erected on site for inspection by the Local Planning Authority and the walls shall thereafter be constructed in accordance with the approved panel.
Reason: To ensure that the details of the development are to an acceptable standard to enhance the character and appearance of the Conservation Area in accordance with Policy CON7 of the South Oxfordshire Local Plan.
That temporary works shall be carried out to the coach house to secure its safety and stability during the alterations and to provide protection for the building before any work is undertaken in pursuance of this permission (coach house).
Reason: To secure the safety and protection of the listed building in accordance with Policy CON6 of the South Oxfordshire Local Plan.
That prior to first occupation of any of the proposed dwellings, the access and turning facilities shall be constructed in all respects in accordance with drawing 10321/03j and maintained thereafter.
Reason: To ensure satisfactory access and turning facilities are provided in the interests of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan.
The development shall not commence until details of temporary site storage facilities for construction materials, plant and vehicles has been submitted to and approved in writing by the Local Planning Authority. Prior to commencement of works to excavate foundations of any proposed building on the site, the temporary storage facilities shall be completed in all respects in accordance with the approved details and maintained in a good working order throughout construction and as required after that period.
Reason: To ensure satisfactory temporary construction facilities for materials, plant and vehicles is provided in the interests of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan.
That the parking provision shall be as shown on drawing 10321/03j all constructed, surfaced and laid out prior to occupation of the dwellings and thereafter retained Any alteration to the approved parking layout shall first be agreed in writing with the Local Planning Authority. Provision for secure cycle parking shall be made available as indicated on drawing 10321/03j prior to occupation of the dwellings.
Reason: To comply with the Local Planning Authority's vehicle/cycle parking standards and in the interests of highway safety in accordance with Policies T2 and D2 of the South Oxfordshire Local Plan.
That before any works of demolition are undertaken to the Lamb garage building, the applicant shall take such steps and carry out such works as shall secure the safety and stability of the front wall of the building which is to be retained (Lamb Garage).
Reason: To ensure the safety and protection of the building in accordance with Policy CON6 of the South Oxfordshire Local Plan.
That the development shall not take place until the Local Planning Authority are satisfied that contamination has been investigated and remedial action agreed by the Local Planning Authority. The site shall then not be occupied until the following action is implemented and approved by the Local Planning Authority.
i. "The following measures (a-d) shall be undertaken to investigate and remediate any contamination on the site prior to commencement of the development:
a) A desk study shall be submitted to and approved in writing by the Local Planning Authority. This study shall be conducted fully in line with the approach indicated in BS 10175: 2001 (Investigation of potentially contaminated sites - code of practice). The study shall include the identification of all previous site uses, potential contaminants that might reasonably be expected given those uses and other relevant information. If contamination is suspected at the site the information obtained must then be used to formulate an initial conceptual model for the site including all potential contaminant sources, pathways and receptors.
b) Where contamination is identified as having the potential to be present in a) above, proposals for a site investigation to characterise the site must be submitted to and approved in writing by the Local Planning Authority. This proposal shall be designed having regard to the approved desk study and BS 10175. It should be clear about what information it seeks to obtain and how this will refine the initial conceptual model for the site.
c) The approved site investigation referred to on b) above shall be fully implemented and a report submitted to the Local Planning Authority for written approval. The report shall be in line with BS 10175 and detail the works undertaken to characterise the site and contain a refined conceptual model in the light of the results of the investigation. N.B. If the Local Planning Authority is not satisfied that the site has been adequately characterised after the first stage of investigation, further works will be required to clarify any remaining uncertainties.
d) Where unacceptable levels of contamination are identified, a remediation scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall incorporate details of the procedures and documentation employed to validate the remediation measures identified in c) above.
ii. Prior to occupation of the site, the approved remediation and validation schemes in d) above shall be fully implemented and a report submitted and approved in writing by the Local Planning Authority.
Reason: To ensure safe occupation and prevent pollution of the water environment in accordance with Policies EP7 and EP8 of the South Oxfordshire Local Plan.
That a fire hydrant shall be provided within the application site prior to the first occupation of the dwellings.
Reason: To ensure adequate facilities for fire fighting purposes in accordance with Policy D11 of the South Oxfordshire Local Plan.
That the communal bin storage area shall be provided prior to the first occupation of any dwelling as indicated on drawing 10321/03g and shall be retained thereafter for all the dwellings.
Reason: To ensure that provision for waste management is available on the site in accordance with Policy D10 of the South Oxfordshire Local Plan.
That no development shall take place within the application area until the applicant, or their agents or successors in title, has secured the implementation of a staged programme of archaeological mitigation measures in accordance with a written scheme of investigation which shall first have been submitted to and approved by the Local Planning Authority. The programme of work shall include all processing, research and analysis necessary to produce an accessible and useable archive and a full report for publication. The work shall be carried out by a professional archaeological organisation acceptable to the Local Planning Authority.
Reason: As the site is of archaeological importance and in accordance with Policy CON13 of the South Oxfordshire Local Plan.
That notwithstanding the provisions of Article 3 of, and Classes A, B, C and D of Part 1 of Schedule 2 of the Town and Country Planning General Development Order 1995(or any order revoking or re-enacting that order) no extensions or additions falling within those Classes shall be carried out unless planning permission has first been granted by the Local Planning Authority.
Reason: To protect local amenities in accordance with Policy H4 of the South Oxfordshire Local Plan.
That a scheme for soft landscaping of the site, which shall include the planting of at least two trees to be placed in a linear tree pit within the car park area, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development . The approved scheme shall be implemented within 12 months of commencement of the development hereby permitted. In the event of any of the trees or shrubs being damaged or dying within 5 years of implementation they shall be replaced with a specimen of the same size and species.
Reason: To help to assimilate the development in its surroundings in accordance with Policy G9 of the South Oxfordshire Local Plan.
That surface water drainage details, incorporating sustainable drainage principles and an assessment of the hydrological and hydrogeological context of the development, shall be submitted to and approved in writing by the Local Planning Authority.
Reason: To prevent the increased risk of flooding and to improve water quality and maximize the value of wildlife and habitat of the drainage features in accordance with Policies EP6 and EP7 of the South Oxfordshire Local Plan.
That samples of new walling material including stone for the lintels to be used for the coach house and other dwellings shall first be submitted to and approved in writing by the Local Planning Authority. A sample panel of the rebuilt walling using a traditional lime mortar mix shall be erected on site and inspected and agreed by the Local Planning Authority before the works to the building commence. The new work shall be carried out in accordance with the approved panel.
Reason: To ensure that works to the listed building safeguard its character and historic interest in accordance with Policy CON4 of the South Oxfordshire Local Plan.
That all rainwater goods shall be constructed of cast iron.
Reason: To ensure that the details of the development are to an acceptable standard to enhance the character and appearance of the Conservation Area in accordance with Policy CON4 of the South Oxfordshire Local Plan.
