Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

Prior to the commencement of development, details of an attenuation/storage function to control the runoff from Barlow Close shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health and to comply with policies G2 and EP7 of the adopted South Oxfordshire Local Plan.

That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced. Reason: To safeguard the character of the area and to comply with policies G2 and H4 of the adopted South Oxfordshire Local Plan.

A scheme for the hard and soft landscaping of the site, which should include details for the planting of live trees and shrubs, for the treatment of the driveway, parking area and for the provision of boundary fences ( including the enclosure of front garden area with low fences, walls or railings) and screen walling, shall be submitted to and approved in writing by the local planning authority prior to the commencement of the development hereby permitted. Reason: To help to assimilate the development into its surroundings and to comply with policies G2 and C1 of the adopted South Oxfordshire Local Plan.

The approved scheme shall be implemented within 12 months of the commencement of the development hereby permitted. In the event of any of the trees or shrubs so planted dying or being seriously damaged , destroyed or diseased within 3years of the completion of the development , they shall be replaced by an equivalent number of trees and shrubs of the same species in the next planting season following their demise,unless otherwise previously agreed to in writing by the local planning authority. Reason: To help to assimilate the development into its surroundings and to comply with policies G2 and C1 of the adopted South Oxfordshire Local Plan.

That prior to the occupation of the proposed dwelling, the proposed means of access onto Barlow Close is to be formed, laid out and constructed to the apporval of the Highway Authority strictly in accordance with the highway authority's specifications and that all ancillary works specified shall be undertaken. Reason: In the interests of highway safety and convenience and to comply with policies G2 and T1 of the adopted South Oxfordshire Local Plan.

Before the proposed dwelling is first occupied, the parking and manoeuvring areas shall be provided in accordance with the plan (836-1A) hereby approved and shall be constructed, laid out, surfaced (bound material), drained and completed, and shall be retained unobstructed except for the parking and manoeuvring of vehicles at all times. Reason: In the interests of highway safety and convenience and to comply with policies G2 and T1 of the adopted South Oxfordshire Local Plan.

Gas protective measures should be incorporated in to the design of the building in accordance with 1) unless a risk assessment is undertaken that demonstrates this is not necessary in accordance with 2). 1. Gas protective measures shall be incorporated into the design of the building following the measures a-b) and in accordance with the approach outlined in BRE 212; Construction of New Buildings on Gas- Contaminated Land or CIRIA 149; Protecting Development from Methane. These measures shall include: a) Production of proposals for gas protective measures . These shall be submitted to and approved by the LPA before the development commences. b) After approval by the LPA, gas protective measures shall be fully implemented and a report submitted to and approved in writing by the LPA before occupation of the site. 2. The following measures ( a-c) shall be undertaken to identify and investigate any gaseous contamination on the site prior to the commencement of the development and to remediate prior to occupation of the development. a) A site investigation proposal to characterise any gaseous contamination on the site is submitted to and approved in writing by the LPA. This proposal shall be designed having regard to the approved desk study , the initial conceptual site model and BS 10175 and shall be approved by the LPA before the investigation commences. It should be clear about what information it seeks to obtain, how this will refine the initial conceptual model for the site and that it will be comprehensive enough to enable any necessary risk assessments. b) The approved site investigation referred to in b) above shall be fully implemented and a report submitted to the LPA for written approval. The report shall be in line with BS 10175, detail the works undertaken to characterise the site which must include a risk assessment and contain a refined conceptual model in the light of the results of the investigation. NB If the LPA is not satisfied that the site has been adequately characterised after the first stage of investigation, further works will be required to clarify any remaining uncertainties. c) Where unacceptable levels of gaseous contamination are identified, a proposal for a remediation scheme including measures to validate the remediation shall be submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use and to comply with policies G2 and EP8 of the adopted South Oxfordshire Local Plan.

That the development shall not take place until the Local Planning Authority are satisfied that contamination has been investigated and remedial action agreed by the Local Planning Authority. The site shall then not be occupied until the following action is implemented and approved by the Local Planning Authority. i. "The following measures (a-d) shall be undertaken to investigate and remediate any contamination on the site prior to commencement of the development: a) A desk study shall be submitted to and approved in writing by the Local Planning Authority. This study shall be conducted by a suitably qualified person and fully in line with the approach indicated in BS 10175: 2001 (Investigation of potentially contaminated sites - code of practice). The study shall include a site walkover and the identification of all previous site uses, potential contaminants that might reasonably be expected given those uses and other relevant information. If contamination is suspected at the site the information obtained must then be used to formulate an initial conceptual model for the site including all potential contaminant sources, pathways and receptors. b) Where contamination is identified as having the potential to be present in a) above, proposals for a site investigation to characterise the site must be submitted to and approved in writing by the Local Planning Authority. This proposal shall be designed having regard to the approved desk study and BS 10175. It should be clear about what information it seeks to obtain and how this will refine the initial conceptual model for the site. c) The approved site investigation referred to on b) above shall be fully implemented and a report submitted to the Local Planning Authority for written approval. The report shall be in line with BS 10175 and detail the works undertaken to characterise the site and contain a refined conceptual model in the light of the results of the investigation. All chemical analysis shall be undertaken by MCERTS accredited laboratories. N.B. If the Local Planning Authority is not satisfied that the site has been adequately characterised after the first stage of investigation, further works will be required to clarify any remaining uncertainties. d) Where unacceptable levels of contamination are identified, a remediation scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall incorporate details of the procedures and documentation employed to validate the remediation measures identified in c) above. ii. Prior to occupation of the site, the approved remediation and validation schemes in d) above shall be fully implemented and a report submitted and approved in writing by the Local Planning Authority. Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use and to comply with Policies G2, EP1 and EP8 of the adopted South Oxfordshire Local Plan.
