Conditions / Refusal Reasons
That having regard to the excessive size and bulk of the proposed building and to its inappropriate design features, the proposal to erect 6 two bedroom flats together with parking and amenity space would appear out of keeping with and detract from the character and appearance of the area. As such the proposal would neither preserve nor enhance the character and appearance of the Henley on Thames Conservation Area and it would be contrary to policies G2, G6, CON 7, D1 and H4 of the adopted South Oxfordshire Local Plan, to advice contained in the South Oxfordshire Design Guide and to Government guidance set out in PPG 15.
That the proposal would result in the permanent loss of four established trees on the site and could threaten the future health and longevity of additional trees on and outside of the site that are shown to be retained. The loss of trees would detract from both the character and appearance of the site and views into the site from the Conservation Area and in this way the proposal would be contrary to policies G2, C9, H4 and CON 7 of the adopted South Oxfordshire Local Plan.
That having regard to the size, bulk and height of the proposed new building and to its proximity to the boundaries with number 1 Pearces Orchard and the residential flats accommodated within numbers 1 - 3 Fairmile, the proposal would appear unacceptably overbearing in the outlook from these properties and would detract from the enjoyment of their garden area. In addition the vehicular traffic that would be generated by the proposal would result in increased noise and disturbance particularly to the occupiers of number 1 Pearces Orchard. In this way the proposal would be detrimental to the standard of amenities enjoyed by the occupiers of these properties and would be contrary to policy H4 of the adopted South Oxfordshire Local Plan and to advice contained in the South Oxfordshire Design Guide.
