Conditions / Refusal Reasons
That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no windows shall be inserted in the rear (north) elevation of Summit House, and no windows shall be inserted above ground floor level in the terraced development other than those expressly authorised by this permission, without the prior grant of planning permission from the Local Planning Authority. Reason: To protect local amenities in accordance with Policy D4 of the adopted South Oxfordshire Local Plan.

That the first floor bathroom windows in the south elevation of the three terraced houses hereby permitted shall be glazed in obscure glass prior to the first occupation of any unit and shall thereafter be retained as such. Reason: To prevent overlooking in accordance with Policy D4 of the adopted South Oxfordshire Local Plan.

That within 21 days from the date of this decision, comprehensive details of landscape works shall be submitted to and approved in writing by the Local Planning Authority. The details shall include any existing features or planting to be retained, planting proposals including schedules of plants, species, sizes, numbers and densities, all hard surfaces, changes in levels, means of enclosure such as walls and fencing with particulars of height, materials and fencing style. Reason: To help assimilate the development into its surroundings in accordance with Policy C9 of the adopted South Oxfordshire Local Plan.

The approved landscape works shall be implemented prior to the first occupation of any residential unit. Except as may otherwise be agreed in writing by the local planning authority, any vegetation which dies, exhibits dieback or is damaged within 5 years of implementation shall be replaced with a specimen of the same species and size within the following planting season. Reason: To help assimilate the development into its surroundings in accordance with Policy C9 of the adopted South Oxfordshire Local Plan.

That prior to the first occupation of any dwelling, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience in accordance with Policy T1 of the adopted South Oxfordshire Local Plan.

That prior to the first occupation of any dwelling the vision splays at the access point shall be provided in accordance with the details shown on plan reference 2504 10 Rev. L accompanying planning application P05/E0677, and shall be so retained and maintained. Reason: In the interests of highway safety and convenience in accordance with Policy T1 of the adopted South Oxfordshire Local Plan.

Before the development is first occupied, the parking and manoeuvring areas shall be provided in accordance with plan ref. Q/1359/2, rev C, hereby approved and shall be constructed, laid out , surfaced (bound material), drained and completed, and shall be retained unobstructed except for the parking of vehicles at all times. Reason: In the interests of highway safety and convenience in accordance with Policy D2 of the adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no development falling within Classes A, B and C of Schedule 2. Part 1 of the Order shall be undertaken unless planning permission has been granted by the Local Planning Authority on a formal application submitted for such development. Reason: To protect visual and residential amenities in accordance with Policies H4 and H13 of the adopted South Oxfordshire Local Plan.

That within 21 days from the date of this decision, a detailed scheme for the provision of a bin and recycling enclosure shall be submitted to and approved in writing by the Local Planning Authority. The enclosure shall be implemented in accordance with the approved plan prior to the first occupation of any residential unit on the site. Reason: To ensure that adequate provision for the management of waste is provided on the site in accordance with Policy D10 of the adopted South Oxfordshire Local Plan.

That the existing leylandii trees along the northern boundary of the site shall be retained. In the event of any of the trees dying within 5 years of implementation of the development, they shall be replaced with a specimen of the same species within the following planting season. Reason: To ensure that the details of the development are satisfactory in accordance with Policy C9 of the adopted South Oxfordshire Local Plan.
