Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That no vents, pipes or flues shall at any time be placed on the front elevation of the building. Reason: To safeguard the character of the area in accordance with Policy G2 of the South Oxfordshire Local Plan.

That the new door and window on the rear elevation shall match the existing door and window. Reason: To ensure that the details of the development are satisfactory in accordance with Policy G2 of the South Oxfordshire Local Plan.

That the ground floor air conditioning units shall not be used outside the hours of 8 am to 6 pm Monday to Saturday and shall not be used on Sundays or Bank Holidays. Reason: To protect the occupiers of the development from noise disturbance in accordance with Policies EP1 and EP2 of the South Oxfordshire Local Plan.

No development shall take place until a detailed scheme for protecting the dwellings from the external noise environment of the area and from internal noise arising from ventilation plant associated with the development has been submitted to and approved, in writing, by the Local Planning Authority. The scheme itself shall be designed, specified and constructed so that the sound insulation performance of the structure and the layout of the dwellings is such that the indoor ambient noise levels do not exceed the 'good' values as detailed in Table 5 of BS 8233:1999 "Sound insulation and noise reduction for buildings - Code of practice". Thereafter, the development shall not be carried out other than in accordance with such approved scheme which shall be completed before any part of the accommodation hereby approved is occupied, unless the Local Planning Authority otherwise agrees in writing. Reason: To protect the occupiers of the development from noise disturbance in accordance with Policies EP1 and EP2 of the South Oxfordshire Local Plan.

That habitable rooms with windows fronting onto Duke Street at first floor level shall be provided with mechanical ventilation extracting air from the rear of the property. The mechanical ventilation shall be provided in accordance with a scheme which shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development. Such mechanical ventilation shall be retained as approved (until such time as it can be demonstrated that the concentration of nitrogen dioxide at the window to that room does not exceed the national Air Quality Objective of 40 µg.m-3 measured as an annual mean). Reason: To protect the occupiers of the development from noise disturbance in accordance with Policies EP1 and EP2 of the South Oxfordshire Local Plan.

No development shall take place until a detailed scheme for the protection of dwellings in the area from noise from the mechanical ventilation plant has been submitted to and approved, in writing, by the Local Planning Authority. The details should demonstrate that an assessment has been carried out in accordance with BS4142:1997 "Method for rating industrial noise affecting mixed residential and industrial areas" and that a 1m from the facade of the nearest potentially affected premises the rating level will be no greater than the L90 background level. Thereafter, the development shall not be carried out other than in accordance with such approved scheme which shall be completed before any part of the accommodation hereby approved is occupied, unless the Local Planning Authority otherwise agrees in writing. Reason: To protect the occupiers of the development from noise disturbance in accordance with Policies EP1 and EP2 of the South Oxfordshire Local Plan.
