Conditions / Refusal Reasons
That the parking provision shall be as shown on the deposited drawing, reference BS000/05 all constructed, surfaced and laid out, retained and maintained to the satisfaction of the Local Planning Authority. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policy D2 of the adopted South Oxfordshire Local Plan.

That the proposed rooflights shall be conservation style and shall be so retained. Reason: To safeguard the character of the listed buildings in accordance with Policy CON3 of the adopted South Oxfordshire Local Plan.

That details of the type design and external finish of all windows, external doors and rainwater goods shall be as set out in the agent's letter dated 27 September 2006 with accompanying information. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G6 and CON3 of the adopted South Oxfordshire Local Plan.

That no dwelling shall be occupied until the planting, landscape and nature conservation works set out in Chiltern Forestry letter submitted as part of planning permission P04/E1169, and set out on plan reference 489/6B accompanying agent's letter dated 27 September 2006 have been undertaken. Such planting and nature conservation works shall be retained and maintained as approved. Any trees or plants which die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason: To protect the landscape features and biodiversity of the site in accordance with Policies C6 and C9 of the adopted South Oxfordshire Local Plan.

That the materials to be used for the construction of the external walls and roofs of the buildings shall be as approved under planning permission P04/E1169. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G6, CON3 and CON4 of the adopted South Oxfordshire Local Plan.

That no demolition or alteration of any existing building or part of any existing building other than the demolitions and alterations shown on the approved drawings shall take place without the prior written consent of the Local Planning Authority. Reason: To ensure a satisfactory appearance to the development and to the conversion of these barns in accordance with Policy E8 of the adopted South Oxfordshire Local Plan.

That during construction, no solid matter shall be stored within 10 metres of the banks of the Cuttlebrook or tributaries and thereafter no storage of materials shall be permitted in this area. Reason: To prevent solid materials form entering the Cuttlebrook tributaries and causing pollution in accordance with Policy EP7 of the adopted South Oxfordshire Local Plan.

Notwithstanding the provisions of Article 3 of, and Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Classes A, B, C, D and E of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To ensure that the character of the buildings and their settings are retained in accordance with Policies CON3 and CON4 of the adopted South Oxfordshire Local Plan.

That prior to the first occupation of either unit 4 or unit 5, the rear gardens of those properties shall be enclosed by the erection of a brick wall in materials to match the existing building. Reason: To ensure that the character of the buildings and their settings are retained in accordance with Policies CON3 and CON4 of the adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order) the garage accommodation shall be retained as such and shall not be adapted for living purposes without the prior grant of planning permission by the Local Planning Authority on a formal application in respect thereof. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policies D2 and G2 of the adopted South Oxfordshire Local Plan.

That the bat mitigation measures agreed under planning permission P04/E1169 shall be implemented as approved prior to the first occupation of any dwelling. Reason: To protect the ecological interest of the site in accordance with Policy C8 of the adopted South Oxfordshire Local Plan.

That the external staircases shall be constructed in timber, dark stained, and shall be so retained and maintained. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G6 and CON4 of the adopted South Oxfordshire Local Plan.

No dwelling shall be occupied until the Local Planning Authority are satisfied that contamination has been sufficiently investigated and any remedial action approved. The site shall then not be occupied until any agreed action is implemented and approved by the Local Planning Authority. i. The following measures (a-d) shall be undertaken to investigate and remediate any contamination on the site prior to commencement of the development: a) A desk study shall be submitted to and approved in writing by the Local Planning Authority. This study shall be conducted fully in line with the approach indicated in BS 10175: 2001 (Investigation of potentially contaminated sites - code of practice). The study shall include the identification of all previous site uses, potential contaminants that might reasonably be expected given those uses and other relevant information. If contamination is suspected at the site the information obtained must then be used to formulate an initial conceptual model for the site including all potential contaminant sources, pathways and receptors. b) Where contamination is identified as having the potential to be present in a) above, proposals for a site investigation to characterise the site must be submitted to and approved in writing by the Local Planning Authority. This proposal shall be designed having regard to the approved desk study and BS 10175. It should be clear about what information it seeks to obtain and how this will refine the initial conceptual model for the site. c) The approved site investigation referred to on b) above shall be fully implemented and a report submitted to the Local Planning Authority for written approval. The report shall be in line with BS 10175 and detail the works undertaken to characterise the site and contain a refined conceptual model in the light of the results of the investigation. N.B. If the Local Planning Authority is not satisfied that the site has been adequately characterised after the first stage of investigation, further works will be required to clarify any remaining uncertainties. d) Where unacceptable levels of contamination are identified, a remediation scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall incorporate details of the procedures and documentation employed to validate the remediation measures identified in c) above. ii. Prior to occupation of the site, the approved remediation and validation schemes in d) above shall be fully implemented and a report submitted and approved in writing by the Local Planning Authority. Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use in accordance with Policy EP7 of the adopted South Oxfordshire Local Plan.
