Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That, the existing detached garage shall be removed prior to the first use of the approved structure.
Reason: To ensure a satisfactory development of the site in accordance with Policies G2, G6, H13, C9, CON7 and D2 of the adopted South Oxfordshire Local Plan 2011.
That the ground and upper floor of the approved building shall only be used in the manner described in the applicant's correspondence dated 23rd September 2006 as a garage/store and games room and for purposes incidental to and in connection with the occupation of Orchard Green as a single family dwelling.
Reason: To provide adequate parking for cars, to protect neighbour amenity and safeguard the character of the area in accordance with Policies G2, G6, and H13, C2 and CON7 of the adopted South Oxfordshire Local Plan 2011.
That, notwithstanding the provisions of the Town and Country Planning General Development Order 1995 (or any order revoking and re-enacting that Order) no additional windows shall be constructed in the elevations or roofslopes of the approved building.
Reason: To ensure that the development is not unneighbourly in accordance with Policy H13 of the adopted South Oxfordshire Local Plan 2011.
That, samples of the materials to be used for the external walls and roof shall be submitted to and approved in writing by the Local Planning Authority before any development commences.
Reason: To ensure that the details of the development are satisfactory in accordance with Policies G2, G6, H13, C2 and CON7 of the adopted South Oxfordshire Local Plan 2011.
That, details of the exterior finishes shall be submitted to, and approved in writing by the Local Planning Authority prior to the commencement of the development.
Reason: To ensure that the details of the development are satisfactory in accordance with Policies G2, G6, H13, C2 and CON7 of the adopted South Oxfordshire Local Plan 2011.
That, details of the windows and doors at 1:20 and 1:5 (section and elevation) shall be submitted to, and approved in writing by the Local Planning Authority prior to the commencement of the development.
Reason: To ensure that the details of the development are satisfactory in accordance with Policies G2, G6, H13, C2 and CON7 of the adopted South Oxfordshire Local Plan 2011.
That, details of the exterior stair at 1:20 and 1:5 (section and elevation) shall be submitted to, and approved in writing by the Local Planning Authority prior to the commencement of the development.
Reason: To ensure that the details of the development are satisfactory in accordance with Policies G2, G6, H13, C2 and CON7 of the adopted South Oxfordshire Local Plan 2011.
That, details of the soft and hard landscaping and samples of materials for hard landscaping shall be submitted to, and approved in writing by the Local Planning Authority prior to the commencement of the development.
Reason: To ensure that the details of the development are satisfactory in accordance with Policies G2, G6, H13, C2 and CON7 of the adopted South Oxfordshire Local Plan 2011.
That except insofar as may be otherwise agreed in writing by the Local Planning Authority, all trees, shrubs and hedges on the land shall be retained and protected during the course of the development and for a period of five years following the completion of the development. Any trees, shrubs or plants which within that period die, are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species, unless the Local Planning Authority gives written consent to any variation.
Reason: To safeguard the character of the area in accordance with Policies C2, C9, H13 and CON7 of the adopted South Oxfordshire Local Plan 2011.
That, details of the pad footing shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development.
Reason: To protect trees and hedging of amenity value within close proximity of the proposed garage in accordance with Policies G2 and C9 of the adopted South Oxfordshire Local Plan 2011.
