The application site adjoins private residential garden areas and the extended use of the patio/garden area by customers would be detrimental to the amenity of occupiers of neighbouring residential properties due to the additional noise disturbance that would result. In addition, there has been no identifiable change in circumstances since those existing at the time of the impostion of Condition 5 of planning permission P97/S0544, which would warrant an extension of the hours of use of the patio/garden area. As such the proposal is contrary to Policies G2, EP2 and TC2 of the South Oxfordshire Local Plan 2011.
