Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the noise levels emitted by the fan motor required to run the extraction unit shall not exceed 45dB LAeq (15 min) at the nearest window to an habitable room. Reason: To ensure that the development is not unneighbourly in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

That the materials to be used for the external walls and roof of the extension and for making good the front elevation shall be of the same colour, type and texture as those used on the existing building. Reason: To ensure that the details of the development are satisfactory in accordance with Policy G1 of the adopted South Oxfordshire Local Plan.

The fan motor required to run the extraction unit shall not operate between the hours 19.00 and 7.00 hours. Reason: To ensure that the development is not unneighbourly in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

That the premises shall not be open to the public between the hours of 19.00 - 7.00am on any day. Reason: To ensure that the development is not unneighbourly in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of development a full specification of kitchen extraction system shall be submitted to and approved in writing by the Local Planning Authority. The specification shall include: 1) The noise levels generated by the unit at the nearest residential property; 2) The odour abatement system, indicating the filtration method and efflux velocity; and 3) The maintenance regime for the equipment and filters. The scheme shall be fully implemented in accordance with the approved details prior to the first use of the premises. Reason: To ensure that the proposal is not unneighbourly in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

That a scheme for sound insulation between the ground and first floor of the premises shall be submitted to and approved in writing prior to commencement of development. The sound insulation scheme shall be provided in accordance with the approved details prior to the first use of the fast food cafe and shall be retained as such. Reason: To protect the amenity of the occupants of the first floor flats in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

That the open areas to the front and rear of the building shall not be used as an extension to the dining area and no tables or chairs in connection with the use of the premises as a cafe shall be placed in these areas. Reason: To protect the amenity of residents of nearby flats in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.
