Conditions / Refusal Reasons
That the development be carried out strictly in accordance with the particulars of the development contained in application S.10/05 as shown on plan numbers 5020740/930/100/P01/P2 & 5020740.024/OXF/P03/P6 accompanying the application except as controlled or modified by conditions of this permission, unless otherwise agreed in writing by the Director for Environment & Economy. Reason: To ensure the details of the development are carried out in accordance with the application as approved.

That development must be begun not later than the expiration of three years beginning with the date hereof. Reason: By decision of the Local Planning Authority in accordance with Section 91 (1) (b) of the Town and Country Planning Act, 1990 to secure the proper timing of the development.

That the car park shall not be constructed until the final design and layout of spaces and landscaping have been approved in writing by the Director for Environment & Economy. Reason: To ensure that adequate parking provision is made without damaging trees on the southern boundary of the site. (Policies G2 (OSP); G6, D1 (SOLP2011)).

That the car park shall not be brought into use until a management scheme has been submitted to and approved in writing by the Director for Environment & Economy. Reason: In the interests of highway safety. (Policies: CF2 (SOLP2011)).

That the land be landscaped and planted with trees and shrubs in accordance with a comprehensive planting and landscaping scheme, which shall be submitted to and approved by the Director for Environment & Economy in writing prior to the commencement of the development and that trees and shrubs so planted be properly maintained and that in the event of any of the trees or shrubs dying or being seriously damaged or destroyed within a period of five years from the completion of the development a new tree or shrub or equivalent number of trees or shrubs as the case may be, be planted and properly maintained in a position or positions as first approved by the Director for Environment & Economy. The landscaping scheme shall include additional planting on the southern boundary of the site. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development. (Policies: G2 (OSP); G6, D1 (SOLP2011)).

That the comprehensive landscaping scheme referred to in condition 5 shall be submitted for approval prior to the commencement of the development hereby permitted and shall be implemented in the first planting season following the first use of the approved development. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development. (Policies: G2 (OSP); G6, D1 (SOLP2011)).

That no development shall take place until the trees on the site which are to be retained and which are adjacent to or within the development area, have been protected during building operations by means of a protective fence around the edge of the canopy of the trees in accordance with B.S. 5837:1991, and with the written requirements (copy attached) of the Director for Environment & Economy relating to the protection of trees. Furthermore, no works or storing of plant or materials shall be carried out within the fenced area. Reason: To ensure the protection of trees on the land and to preserve the amenities of the locality. (Policies: G2 (OSP); G6, D1 (SOLP2011)).
