Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced. Reason: To safeguard the character of the area and to comply with Policies G1 and H5 of the adopted South Oxfordshire Local Plan.

That development shall not begin until a detailed specification of the type, design and external finish of all windows and external doors at a scale of 1:20 (section and elevation) has been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory and to comply with Policies G1, G8 and H11 of the adopted South Oxfordshire Local Plan.

That, prior to the commencement of development, details of paint colour and finishes shall be submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory and to comply with Policies G1, G8 and CON15 of the adopted South Oxfordshire Local Plan.

No development shall commence on site until the applicant has been responsible for organising an archaeological watching brief, to be maintained during the periods of construction/during any groundworks taking place on the site. The watching brief shall be carried out in accordance with a written specification and by a professional archaeological organisation that has first been agreed in writing by the Local Planning Authority. Reason: To safeguard the recording and inspection of matters of archaeological importance on the site and to comply with Policies G1 and CON16 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience and to comply with Policies G1 and G10 of the adopted South Oxfordshire Local Plan.

That the parking provision shall be as shown on the deposited drawing, reference 05046-P01 all constructed, surfaced and laid out, retained and maintained. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities and to comply with Policies G1 and G10 of the adopted South Oxfordshire Local Plan.

A scheme for the hard and soft landscaping of the site, which should include details for the planting of live trees and shrubs, for the treatment of the access road, parking areas and hardstandings and for the provision of boundary fences, (including the enclosure of front garden areas with low fences, walls or railings) and screen walling, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. Reason: To help to assimilate the development into its surroundings and to comply with Policies G1 and G9 of the adopted South Oxfordshire Local Plan.

The approved scheme shall be implemented within 12 months of the commencement of the development hereby permitted. In the event of any of the trees or shrubs so planted dying or being seriously damaged, destroyed or diseased within 5 years of the completion of the development, they shall be replaced by an equivalent number of trees and shrubs of the same species in the next planting season following their demise, unless otherwise previously agreed in writing by the local planning authority. Reason: To help assimilated the development into its surroundings and to comply with Policies G1 and G9 of the adopted South Oxfordshire Local Plan

That the existing trees and hedges on the land shall be protected whilst development operations are in progress, in accordance with details set out in British Standard 5831. Reason: To safeguard the character of the area in accordance with Policies G1 and C16 of the adopted South Oxfordshire Local Plan.

That during the construction of the development, no works, audible past the site boundary, are conducted outside the following times: 8am to 6pm Monday to Friday, 8am to 1pm on Saturdays and no work to occur on Sundays or public holidays. Reason: To ensure that noise and disturbance from construction activities does not interfere with the surrounding residential units and to comply with Policies G1 and G7 of the adopted South Oxfordshire Local Plan.

That the first floor windows in the eastern elevation shall be obscure glazed and thereafter retained as such. Reason: To ensure that the development is not unneighbourly and to comply with Policies G1 and H5 of the adopted South Oxfordshire Local Plan.

That notwithstanding anything contained in the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no additional first floor windows shall be constructed in the walls of the development hereby approved facing east or west. Reason: To ensure that the development is not unneighbourly and to comply with Policies G1 and H5 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of any other works to which this permission relates, the acoustic wall between Brook House and the site shall be constructed and completed. Reason: To ensure that noise and disturbance from construction activities is kept to a minimum and to comply with Policies G1 and G7 of the adopted South Oxfordshire Local Plan.

That details of the surface treatment for the access drive shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. Reason: To ensure that the details of the development are satisfactory and to comply with Policies G1 and H5 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of development a sample of the brick to be used in the construction of the noise attenuating wall shall be submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory and to comply with Policies G2 and H5 of the adopted South Oxfordshire Local Plan.
