Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. Related application(s): P10/W1471/DIS, P11/W1791/DIS

That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced. Reason: To ensure that the details of the development are satisfactory in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

That the trees shown on the approved plans to be retained, shall be protected to the satisfaction of the Local Planning Authority whilst development operations are in progress, in accordance with a scheme to be first agreed in writing with the Local Planning Authority and to be implemented prior to the commencement of the development. Reason: To safeguard trees which are visually important in accordance with Policy C16 of the adopted South Oxfordshire Local Plan.

That a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hardstandings, and the provision of boundary fencing and screen walling shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of Article 3 of, and Class A of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no additional first floor windows shall be inserted in Plots 1, 9 to 18 inclusive and 60 and 61 unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To ensure that the development is not unneighbourly in accordance with Policy H4 of the adopted South Oxfordshire Local Plan.

That the rear elevation of Plots 9 to 18 inclusive, shall be obscure glazed as shown on drawing SK40 and shall thereafter be retained as such. Reason: To ensure that the development is not unneighbourly in accordance with Policy H4 of the adopted South Oxfordshire Local Plan.

That no dwelling shall be occupied until the means of access between the land and the highway has been formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified have been undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That the parking provision shall be as shown on the deposited drawing, all constructed, surfaced and laid out, retained and maintained to the satisfaction of the Local Planning Authority. Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That no dwelling shall be occupied until the means of access between the land and the highway has been formed, laid out and constructed strictly in accordance with the Oxfordshire County Council's specification for the construction of estate streets, and all ancillary works therein specified have been undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and conveniece in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That the footpath links shown on the approved plan shall be constructed and lit to adoptable standards prior to the first occupation of any dwelling. Reason: To ensure adequate links to the footpath network in accordance with Policy G10 of the approved South Oxfordshire Local Plan.

That surface water shall not be disposed of other than in accordance with a detailed surface water drainage scheme which shall first have been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health in accordance with Policy G17 of the adopted South Oxfordshire Local Plan.

That development shall not begin until a scheme for the disposal of foul sewage has been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health in accordance with Policy G17 of the adopted South Oxfordshire Local Plan.

No development shall take place until the Local Planning Authority are satisfied that contamination has been sufficiently remediated in accordance with a remediation and validation scheme, which shall first have been submitted to and approved in writing by the Local Planning Authority, to ensure that all unacceptable levels of contamination are remediated before any development takes place. The scheme shall include the procedures and documentation employed to validate the remediation measures identified. The approved scheme shall be completed and all validation measures to be agreed in the scheme shall be undertaken and a report submitted and approved in writing by the Local Planning Authority before any dwelling is occupied. Reason: To ensure that any ground and water contamination is identified and adequately addressed, to ensure the safety of the development, the environment and the public and ensure the site is suitable for the proposed use in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

That external bin stores shall be provided in accordance with a scheme to be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development. Each approved bin store shall be provided prior to the occupation to which the store relates. Reason: To ensure satisfactory comprehensive development in accordance with Policy D10 of the adopted South Oxfordshire Local Plan.

That, in the event that demolition of the remaining buildings on site takes place more than 12 months after the date of this permission, a further bat survey of the site and buildings shall be undertaken. In the event that the survey reveals the presence of bats, appropriate mitigation shall be undertaken prior to the demolition. Reason: To prevent damage to a wildlife habitat in accordance with Policy C8 of the adopted South Oxfordshire Local Plan.
