Conditions / Refusal Reasons
That the development be carried out strictly in accordance with the particulars of the development contained in application S.01/06 as shown on plan numbers 783057/A10.01/P2, /A10.2, /A10.03/P1, /A11.01, /A13.01/P1, /A14.01 & /A25.01 accompanying the application except as modified by conditions of this permission, unless otherwise agreed in writing by the Director for Environment & Economy. Reason: To ensure the details of the development are carried out in accordance with the application as approved.

That development must be begun not later than the expiration of three years beginning with the date hereof. Reason: By virtue of the provisions of Section 91 (1) (a) of the Town and Country Planning Act, 1990.

That the external walls and roofs of the buildings/dwellings be constructed and finished in accordance with a Schedule of Materials and Finishes which shall first have been submitted to and approved in writing by the Director for Environment & Economy. Reason: To ensure the Materials and Finishes are compatible with the surrounding development. (Policies: G2 (OSP2016); D1 (SOLP) 2011))

That the colour of the proposed fencing shall be agreed in writing by the Director for Environment & Economy, prior to the commencement of the development. Reason: In the interests of visual amenity. (Policies: G2 (OSP2016); G2 (SOLP2011))

That no removal of trees shall take place during the bird nesting season. Reason: To ensure there is no disruption to the bird nesting season. (Policies: EN10 (OSP2016); C10 (SOLP2011)

That no development shall take place until the trees on the site which are to be retained and which are adjacent to or within the development area, have been protected during building operations by means of a protective fence around the edge of the canopy of the trees in accordance with B.S. 5837: 2005, and with the written requirements (copy attached) of the Director for Environment & Economy relating to the protection of trees. Furthermore, no works or storing of plant or materials shall be carried out within the fenced area. Reason: To ensure the protection of trees on the land and to preserve the amenities of the locality. (Policies: EN1 (OSP2016); C9 (SOLP2011))

That the land be landscaped and planted with trees and shrubs in accordance with a comprehensive planting and landscaping scheme, which shall be submitted to and approved by the Director for Environment & Economy in writing prior to the commencement of the development and that trees and shrubs so planted be properly maintained and that in the event of any of the trees or shrubs dying or being seriously damaged or destroyed within a period of five years from the completion of the development a new tree or shrub or equivalent number of trees or shrubs as the case may be, be planted and properly maintained in a position or positions as first approved by the Director for Environment & Economy. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development. (Policies: G2 (OSP2016); D8 (SOLP2011))

That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season following the occupation of the buildings or the completion of the development, whichever is the sooner, and any trees or plants which within a period of five years die, are removed or become seriously damaged shall be replaced in the next planting season with others of similar size and species, unless the Director for Environment & Economy gives written consent to any variations. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development. (Policies: G2 (OSP2016); D8 (SOLP2011))

That prior to the commencement of the development, details of a long term surface water drainage strategy for the site shall be submitted to and approved in writing by the Director for Environment & Economy. Reason: To ensure that drainage details are satisfactory and to prevent localised flooding. (Policies: EN9 (OSP2016); EP6 (SOLP))

That prior to the commencement of the development, details of the location and type of acoustic fencing to be used shall be submitted to and approved in writing by the Director for Environment & Economy. Reason: To ensure the creation of a satisfactory environment free from intrusive levels of noise. (Policies: G2 (OSP2016); EP2 (SOLP2011))

That the operational use of the all weather pitch shall be restricted to 8.00 am - 10.00 pm Monday to Saturday and 9.00 am - 5.00 pm Sundays, unless otherwise first agreed in writing by the Director for Environment & Economy. Reason: In order to safeguard the amenities of the area. (Policies: G2 (OSP2016); EP2 (SOLP2011))

That no loudspeakers shall be installed and used on the all weather pitch without the prior written consent of the Director for Environment & Economy. Reason: To ensure the creation of a satisfactory environment free from intrusive levels of noise. (Policies G2 (OSP2016); EP2 (SOLP2011))

That prior to the commencement of the development full details of the proposed floodlighting, cowling and predicted overspill levels of light shall be submitted to and approved in writing by the Director for Environment & Economy. Reason: In the interests of the amenities of the neighbouring residents. (Policies: G2 (OSP2016); EP3 (SOLP2011))

That on installation of the floodlights, an on site assessment of the light pollution levels shall be undertaken by the Director for Environment & Economy and any consequent remedial action be undertaken prior to the use of the floodlighting. Reason: In the interests of the amenities of the neighbouring residents. (Policies: G2 (OSP2016); EP3 (SOLP2011))

That the floodlighting hereby approved shall be used between the hours of dusk and 10.00 pm on Mondays to Saturdays. The floodlights shall not be used on Sundays. Reason: In the interests of the amenities of neighbouring residents. (Policies: G2 (OSP2016); EP3 (SOLP2011))

That there shall be no blockage caused to Footpath no. 6 as a result of construction works undertaken on site as a result of this permission. Reason: To ensure that the public right of way is kept open free from obstruction. (Policies: G2 (OSP2016); R8 (SOLP2011))

That there shall be no parking of vehicles on the grassed areas adjoining the development hereby approved. Reason: In the interests of the visual amenities of the area. (Policies: G2 (OSP2016); D1 (SOLP2011))

That the existing School Travel Plan shall be updated to take account of the development hereby approved and shall be submitted to and approved in writing by the Director for Environment & Economy following consultation with the Travel Plans Development Team. The amended Travel Plan shall be put into operation by the start of the Summer term 2007. Reason: In the interests of highway safety and to encourage more sustainable means of transport. (Policies: T1 (OSP2016)).
