Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the materials to be used for the external walls and roofs shall be as approved under planning permission P03/E0882, or as first agreed in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G6 and CON7 of the adopted South Oxfordshire Local Plan.

That notwithstanding the details accompanying the application development shall not begin until a detailed specification of the type, design and external finish of all windows and external doors has been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G6 and CON7 of the adopted South Oxfordshire Local Plan.

That development shall not commence unless the means of access between the land and the highway has been formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified have been undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience in accordance with Policy T1 of the adopted South Oxfordshire Local Plan.

That work be not commenced on the erection of any dwellings until the carriageways only serving the whole of that portion of the development under construction, have been laid out and constructed to the above mentioned specification, save for wearing course and kerbing. Reason: In the interests of highway safety, to provide protection of the subgrade and to ensure adequate clear running surfaces which will protect adjoining public highways from droppings of spoil, mud, etc in accordance with Policy T1 of the adopted South Oxfordshire Local Plan.

That no dwelling shall be occupied until the whole of the roads and footpaths shown on the layout plan accompanying the application, and all surface water drainage works, have been laid out and constructed in accordance with the Oxfordshire County Council Design Guide for Residential Roads and the specifications agreed with the Local Highway Authority (Oxfordshire County Council). Reason: In the interests of highway safety and convenience in accordance with Policy T1 of the adopted South Oxfordshire Local Plan.

That no dwelling shall be occupied until space has been laid out within the site for vehicles to be parked as shown on drawing no. AR/L10; and such parking spaces shall be retained thereafter. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policy D2 of the adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order) the garage accommodation shall be retained as such and shall not be adapted for living purposes without the prior grant of planning permission by the Local Planning Authority on a formal application in respect thereof. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policy D2 of the adopted South Oxfordshire Local Plan.

That except for the planting adjacent to the new parking area to serve plot 8, the landscaping of the site shall accord with the details approved under planning permission P03/E0882. Details of the new planting area adjacent to the parking area to serve plot 8 shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be carried out within the first planting season following commencement of the development and shall be so retained and maintained. Reason: To help to assimilate the development into its surroundings in accordance with Policies G6 of the adopted South Oxfordshire Local Plan.

That new boundary fencing and walling shall be constructed in accordance with the approved details prior to the first occupation of the dwellings hereby approved and shall be so retained and maintained. Reason: To ensure that the details of the development are satisfactory in accordance with Policy G6 of the adopted South Oxfordshire Local Plan.

Development shall not commence until details of on site drainage works have been submitted to, and approved by, the Local Planning Authority in consultation with the sewerage undertaker. No works which result in the discharge of foul or surface water from the site shall be commenced until the on site drainage works referred to above have been completed. Reason: In the interests of public health and to avoid pollution in accordance with Policy EP1 of the adopted South Oxfordshire Local Plan.

No development approved by this planning permission shall be commenced until: a) A desktop study has been carried out which shall include the identification of previous site uses, potential contaminants that might reasonably be expected given those uses and other relevant information. And using this information a diagrammatical representation (Conceptual Model) for the site of all potential contaminant sources, pathways and receptors has been produced. b) A site investigation has been designed for the site using the information obtained from the desktop study and any diagrammatical representations (Conceptual Model). This should be submitted to, and approved in writing by the Local Planning Authority prior to that investigation being carried out on the site. The investigation must be comprehensive enough to enable: - a risk assessment to be undertaken relating to groundwater and surface waters associated on and off the site that may be affected, and - refinement of the Conceptual Model, and - the development of a Method Statement detailing the remediation requirements c) The site investigation has been undertaken in accordance with details approved by the Local Planning Authority and a risk assessment has been undertaken. d) A Method Statement detailing the remediation requirements, including measures to minimise the impact on ground and surface waters, using the information obtained from the Site Investigation, has been submitted to the Local Planning Authority. This should be approved in writing by the Local Planning Authority prior to that remediation being carried out on the site. Reason: To ensure that the proposed site investigations and remediation will not cause pollution of Controlled Waters in accordance with Policy EP8 of the adopted South Oxfordshire Local Plan.

The development of the site should b e carried out in accordance with the approved Method Statement. Reason: To ensure that the development complies with approved details in the interests of protection of Controlled Waters in accordance with Policy EP8 of the adopted South Oxfordshire Local Plan.

No soakaways shall be constructed such that they penetrate the water table, and they shall not in any event exceed 1 metre in depth below existing ground level. Reason: To prevent pollution of groundwater in accordance with Policy EP7 of the adopted South Oxfordshire Local Plan.

That notwithstanding the provisons of Article 3, Part 1, Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Classes A and B of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To protect local amenities in accordance with Policy G6 of the adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order), no additional windows shall be inserted in the dwellings above ground floor level other than those expressly authorised by this permission. Reason: To protect local amenities in accordance with Policies D4 and G6 of the adopted South Oxfordshire Local Plan.
