Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That a detailed specification of the type, design and external finish of all windows, external doors and shopfront shall be submitted to and approved in writing by the Local Planning Authority prior to development commencing. Reason: To ensure that the appearance of the building(s) is satisfactory in accordance with Policies G2 and CON7 of the adopted South Oxfordshire Local Plan.

That the cheeks and face of the dormer window(s) shall be constructed and finished in accordance with a schedule of materials and finishes which shall first have been submitted to and approved in writing by the Local Planning Authority before development commences. Reason: To ensure that the appearance of the building(s) is satisfactory in accordance with Policies G2 and CON7 of the adopted South Oxfordshire Local Plan.

That samples of the materials to be used for the external wall(s) and roof(s) shall be submitted to and approved in writing by the Local Planning Authority before development/works commence. Reason: To ensure that the appearance of the building(s) is satisfactory in accordance with Policies G2 and CON7 of the adopted South Oxfordshire Local Plan.

That a detailed specification of all external ducts, flue pipes or means of external venting shall be submitted to and approved in writing by the Local Planning Authority before development/works commence. Reason: To ensure that the appearance of the building(s) is satisfactory in accordance with Policies G2 and CON7 of the adopted South Oxfordshire Local Plan.

That habitable rooms fronting on to Duke Street at first and second floor level shall be provided with mechanical ventilation, unless it can be demonstrated by means of an air quality assessment that the concentration of nitrogen dioxide at the window to that room does not exceed the Air Quality Objective of 40ug.m3 measured as an annual mean. The mechanical ventilation shall be provided in accordance with a scheme which shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development. Thereafter such mechanical ventilation shall be retained as approved. Reason: To ensure satisfactory standards of air quality for the residents of the flats in accordance with Policies G2 and EP1 of the adopted South Oxfordshire Local Plan 2011.

That the scheme to provide mechanical ventilation referred to in condition 6 above shall include a detailed noise assessment, to be approved in writing by the Local Planning Authority prior to the commencement of the development, to demonstrate that plant associated with the ventilation system will not adversely affect surrounding residential or commercial accommodation. Reason: To ensure satisfactory standards of residential amenity for the residents of the flats in accordance with Policies G2 and EP1 of the adopted South Oxfordshire Local Plan 2011.
