Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That notwithstanding the details submitted with the application, details of the shape of the ponds and the gradient of the bunds shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of any development. Reason: To help to assimilate the development into its surroundings in accordance with Policies G1 and C3 of the adopted South Oxfordshire Local Plan.

That the receptor ponds hereby approved shall be managed in accordance with the information set out in the Management Plan compiled by James Johnston Ecology submitted as part of the application. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G1 and C3 of the adopted South Oxfordshire Local Plan.

That the works shall be carried out in accordance with the details set out in the programme of works on page 13 of the Ecological Report compiled by James Johnston and submitted with the application. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G1 and C3 of the adopted South Oxfordshire Local Plan.

That all planting, seeding or turfing comprised in the approved scheme of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason: To help to assimilate the development into its surroundings in accordance with Policies G1 and G9 of the adopted South Oxfordshire Local Plan.

That details of any fencing to be erected around the ponds shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of any development. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G1 and C3 of the adopted South Oxfordshire Local Plan.

That details of the treatment of the bunds shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of any development. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G1 and C3 of the adopted South Oxfordshire Local Plan.

That details of how the excavated material will be disposed of shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of any development. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G1 and C3 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of the development hereby approved, a scheme for the translocation of the Great Crested Newt population to the approved pond from the existing pond at the site known as land to the rear of The Swan, Tetsworth, shall be submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory in accordance with Polices G1 and C14 of the adopted South Oxfordshire Local Plan.
