Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That the external walls and roofs shall be constructed and finished in accordance with a schedule of materials and finishes which shall first have been submitted to and approved in writing by the Local Planning Authority before development/works commence. Reason: To ensure that the appearance of the buildings is satisfactory in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

That a detailed specification of the type, design and external finish of all windows, external doors and rainwater goods shall be submitted to and approved in writing by the Local Planning Authority prior to development/works commencing. Reason: To ensure that the appearance of the building(s) is satisfactory in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order) the existing windows in the north elevation of Summit House shall be removed and no further windows are to be inserted in this north elevation or on the north west or south east elevations of the terraced development (except any that may be included on the plans hereby permitted) unless planning permission has been granted by the Local Planning Authority on a formal application submitted for such development. Reason: To protect local amenities in accordance with Policy H11 of the adopted South Oxfordshire Local Plan.

Bathroom window in the south east elevation of the terraced house on the south side of the three terraced houses hereby permitted, shall be glazed in obscure glass prior to the first occupation of the premises and shall thereafter be retained as such. Reason: To ensure that the development is not unneighbourly and to comply with Policy H11 of the adopted South Oxfordshire Local Plan.

No development shall take place until comprehensive details of proposed landscape works have been submitted to and approved in writing by the Local Planning Authority. The details shall include any existing features or planting to be retained; planting proposals including schedules of plants, species, sizes, numbers and densities; all hard surfaces, changes of level and spot heights; means of enclosure such as walls and fencing with particulars of height, materials, brick bonds and fencing style. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.

The approved landscape works shall be implemented within 12 months of the commencement of development. Except as may otherwise be agreed in writing by the local planning authority any vegetation which dies, exhibits, dieback or is damaged within 5 years of implementation shall be replaced with a specimen of the same species and size. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.

Prior to the commencement of any site works (including demolition or site clearance) a detailed arboricultural report including a survey and method statement shall be submitted to and approved in writing by the Local Planning Authority. All trees shown to be retained or on adjacent land shall be protected in accordance with a scheme which complies with BS 5837:1991 Trees in Relation to Construction and shall have been submitted to, and approved in writing by the Local Planning Authority. The agreed measures shall be kept in place during the entire course of development Reason: To safeguard trees which are visually important in accordance with Policies G8 and C16 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That the development shall not be occupied until the planting on each side of the access on the strips of land that are to provide vision splays shown on Drwg No 002 received 28 July 2005 and on Drwg No 01 rev G received 18 July 2005 has been reduced to a height not exceeding 1m, in order to provide forward visibility from the access shown. Any planting within the vision splays shall be retained at a height of less than 1m unless otherwise approved in writing by the Local Planning Authority. Reason: In the interests of highway safety in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.

That the parking provision shall be as shown on the Site Plan drawing Revision G received 8 July 2005 all constructed, surfaced and laid out, retained and maintained to the satisfaction of the Local Planning Authority. Reason: In the interests of highway safety in accordance with Policy G11 of the adopted South Oxfordshire Local Plan.

That development shall not commence until surface water drainage works have been carried out in accordance with details submitted to and approved in writing by the Local Planning Authority. Reason: To prevent pollution and flooding in accordance with Policies G6 and G17 of the adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order) no development falling within Classes A, B and C of Schedule 2, Part 1 of the Order shall be undertaken unless planning permission has been granted by the Local Planning Authority on a formal application submitted for such development. Reason: To protect local amenities in accordance with Policy H11 of the adopted South Oxfordshire Local Plan.

That prior to the commencement of the development, details of the slab levels of the houses shall be submitted to and be approved in writing by the Local Planning Authority and the houses shall only be constructed in accordance with the approved details. Reason: To ensure that the details of the development are satisfactory in accordance with Policy H4 of the adopted South Oxfordshire Local Plan.

That details of the part of the rear wall that is to be retained, following the demolition of the western end of Summit House, shall be submitted to and approved in writing by the Local Planning Authority. The height of the wall shall in any event be no less than 2m and the approved wall shall be retained thereafter, unless otherwise approved in writing by the Local Planning Authority. Reason: To ensure that the development is not unneighbourly and to comply with Policy H11 of the adopted South Oxfordshire Local Plan.
