Demolition of dwelling, garaging and stables, construction of six dwellings and formation of new access. (As amended by Drawing No. 09.04/787-02 Rev A accompanying Agent's letter dated 21 February 2005).
Conditions / Refusal Reasons
That the development would be contrary to the general/environmental/ countryside policies of the approved Oxfordshire Structure Plan particularly policies G1, G5, EN1, EN4 and H1, the adopted South Oxfordshire Local Plan, particularly policies G1, G5, G8, C2, H4, H6 and H18 and the South Oxfordshire Local Plan 2011 Second Deposit Draft 2003 particularly policies G2, G4, G6, C2, H4 and H6. The site lies in a semi rural location beyond the main built up limits of Woodcote. The proposal to erect six dwellings in a backland location would consolidate and extend development into open paddock land, appear out of keeping with the nature of surrounding development and detract from the spacious and rural character of the area which lies within the Chilterns Area of Outstanding Natural Beauty.
That the proposal to erect six dwellings on a backland site would be contrary to policies G1 and H18 of the adopted South Oxfordshire Local Plan and policies G2 and H4 of the South Oxfordshire Local Plan 2011 Second Deposit Draft 2003. It is considered that the new access would cause unacceptable noise, disturbance and light pollution to the occupiers of Rackley and Byways and that a number of the new dwellings would be likely to overlook the private rear garden area of Byways. In addition, having regard to the elevated nature of the site relative to the existing dwellings in Wood Lane and to the fact that the existing leylandi hedge which presently screens the site from view is located on the application site area and could be removed, it is considered that the new dwellings would be likely to overlook and appear overbearing in the outlook from the occupiers of dwellings in Wood Lane.
That insufficient information has been submitted to show that the proposed new houses would not interfere with and cause harm and damage to the existing trees both on the site and on adjacent land in close proximity to the boundary with the site. As such the proposal would be contrary to policies G8 and C16 of the adopted South Oxfordshire Local Plan and policy C10 of the South Oxfordshire Local Plan 2011 Second Deposit Draft 2003.
