Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That samples of the materials to be used for the external walls and roof shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: To ensure that details of the development are satisfactory in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order) the garage, workshop and lobby accommodation at ground floor level shall be retained as shown on drawing 0131 P08A and shall not be converted for additional living accommodation without the prior grant of planning permission by the Local Planning Authority on a formal application in respect thereof. Reason: To ensure the proper planning of the locality and to prevent the creation of a separate and self contained unit in accordance with Policies G8 and H12 of the adopted South Oxfordshire Local Plan.

That the living accommodation above the garage shall not be let or sold separately and shall remain ancillary to the main dwelling, Cherry Orchard. Reason: To ensure the proper planning of the locality and to prevent the creation of a separate self contained unit in accordance with Policy H12 of the adopted South Oxfordshire Local Plan.

Upon the granting of this planning permission the planning permission dated 23rd December 2003 granted by the Council under reference P03/W0990 shall be treated in all respects as having been revoked and no development authorised by the said planning permission shall thereafter be undertaken on the land. Reason: As the implementation of both permissions would not be considered as a limited extension within the Green Belt and would dominate the original dwelling, contrary to Policies GB2 and H12 of the adopted South Oxfordshire Local Plan and Policies GB2 and H13 of the Second Draft Deposit Local Plan.
