Conditions / Refusal Reasons
That the development be carried out strictly in accordance with the particulars of the development contained in application no. S.22/04 as shown on plan numbers 5026600/OXF/P01/P1, 5026600.930/OXF/P02/P1, P03/P1, 5020740.930/OXF/P04/P1, 5026600.930/OXF/P05/P1 accompanying the application, as amended by Design Statement for Resubmission (dated 14/09/05) and plan nos. 5026600/OXF/P01/P1, PL/0/01, PL/0/02/C, PL/0/03, PL/0/04 & PL/0/05 and except as modified by conditions of this permission unless otherwise agreed in writing by the Director for Environment & Economy. Reason: To ensure the details of the development are carried out in accordance with the application as approved.

That development must be begun not later than the expiration of three years beginning with the date hereof. Reason: By virtue of the provisions of Section 91 (1) (a) of the Town and Country Planning Act, 1990.

That the external walls and roofs of the buildings/dwellings be constructed and finished in accordance with a Schedule of Materials and Finishes which shall first have been submitted to and approved in writing by the Director for Environment & Economy. Reason: To ensure the Materials and Finishes are compatible with the surrounding development. (Policies: G2 (OSP2016); G8 (SOLP); G6, D1 (SOLP2011))

That the land be landscaped and planted with trees and shrubs in accordance with a comprehensive planting and landscaping scheme, which shall be submitted to and approved by the Head of Sustainable Development in writing prior to the commencement of the development and that trees and shrubs so planted be properly maintained and that in the event of any of the trees or shrubs dying or being seriously damaged or destroyed within a period of five years from the completion of the development a new tree or shrub or equivalent number of trees or shrubs as the case may be, be planted and properly maintained in a position or positions as first approved by the Director for Environment & Economy. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development. (Policies: G2 (OSP2016); G8 (SOLP); G6, D8 (SOLP2011))

That the comprehensive landscaping scheme referred to in condition 4 shall be implemented in the first planting season following the first use of the approved development. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development. (Policies: G2 (OSP2016); G8 (SOLP); G6, D8 (SOLP2011))

That no development shall take place until the trees on the site which are to be retained and which are adjacent to or within the development area, have been protected during building operations by means of a protective fence around the edge of the canopy of the trees in accordance with B.S. 5837: 1991, and with the written requirements (copy attached) of the Director for Environment & Economy relating to the protection of trees. Furthermore, no works or storing of plant or materials shall be carried out within the fenced area. Reason: To ensure the protection of trees on the land and to preserve the amenities of the locality. (Policies: G2 (OSP2016); G8 (SOLP); G6, D8 (SOLP2011))

That no services shall be routed under the canopies of any of the trees to be retained on the site without prior approval of the Director for Environment & Economy. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment of the development. (Policies: G2 (OSP2016); G8 (SOLP); G6, D8 (SOLP2011))

Surface water source control measures shall be carried out in accordance with details which shall have been submitted to and approved in writing by the Director for Environment & Economy before development commences. Reason: To prevent the increased risk of flooding and to improve water quality. (Policies: EN1, EN11, EN7 (OSP2016); EP1 (SOLP2011))

That any new lengths of footpath that are to be provided as part of the development, shall be a minimum of 2 metres wide. Reason: To ensure ease of pedestrian use. (Policies: G2 (OSP2016); G8 (SOLP); G6, D1 (SOLP2011))

That prior to the commencement of development, details of proposed guardrails to be provided where they abut the new access road shall be submitted for approval in writing by the Director for Environment & Economy. Reason: To ensure pedestrian safety. (Policies: G2 (OSP2016); G8 (SOLP); G6, D1 (SOLP2011))

That the school shall not be occupied until a scheme for the provision of adequate convenient, secure and covered cycle parking as appropriate has been submitted to and approved by the Director for Environment & Economy and any such approved scheme implemented. Reason: To ensure that adequate cycle parking is provided to encourage more sustainable means of travel to the school. (Policies: G2, T1 (OSP2016); G11 (SOLP); D2 (SOLP2011))

That the building shall not be occupied until the car park has been completed and laid out in accordance with the approved plans. Reason: To ensure that adequate car parking provision is made. (Policies: T2 (OSP2016); G11 (SOLP); T2 (SOLP2011))

That final details of the proposed access to the site from the public highway shall be submitted for approval in writing by the Director for Environment & Economy prior to the commencement of the development. Reason: In the interests of highway safety. (Policies: T2 (OSP2016); T2 (SOLP2011))

That prior to the commencement of the development, details of the proposed fencing (including colour) shall be submitted to and approved in writing by the Director for Environment & Economy. Reason: In the interests of the amenities of the area. (Policies: G2 (OSP2016); G8 (SOLP); G6, D1 (SOLP2011))

That the School shall prepare a School Travel Plan which is to be submitted to and approved by the Director for Environment & Economy following consultation with the Travel Plans Development Team and that plan must be put into operation by the start of the first term following the opening of the new school. Reason: In the interest of highway safety and to encourage more sustainable means of transport. (Policies: T1 (OSP2016); G11 (SOLP); T1, T4 (SOLP2011))
