Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That the materials to be used for the external walls of the extension shall be of the same colour, type and texture as those used on the existing building.
Reason: To ensure that the details of the development are satisfactory in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.
That notwithstanding the details which accompanying the application no development shall begin until full details of the proposed acoustic screen have been submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory and to ensure that the development is not unneighbourly in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.
That the premises shall only be open for service to the public between the hours of 8 am and 9 pm on any day.
Reason: To ensure that the development is not unneighbourly in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.
That no delivery vehicles shall visit the site between the hours of 7 pm and
7 am Monday to Saturday and no delivery vehicles at any time on a Sunday with the exception of newspaper deliveries on any day.
Reason: To ensure that the development is not unneighbourly in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.
That delivery cages shall not be manoeuvred outside the building at any time between the hours of 7 pm and 7 am on any day.
Reason: To ensure that the development is not unneighbourly in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.
That notwithstanding the details which accompany the application no development shall begin until full details of the technical specifications for the proposed refrigeration and air conditioning units have been submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory and to ensure that the development is not unneighbourly in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.
That the rated level of noise from refrigeration and air conditioning units shall not exceed the background level by more than 5 dB(A) between 7.00 am and 11.00 pm and shall not exceed the background at any other time. The noise levels shall be determined at the boundary of the premises and the measurement and rating of the plant shall be made in accordance with the latest British Standard 4142 "Method for rating industrial noise affecting mixed residential and industrial areas".
Reason: To ensure that the development is not unneighbourly in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.
That no development shall take place until the Local Planning Authority are satisfied that contamination has been sufficiently investigated and any remedial action approved in writing. The site shall then not be occupied until any agreed action is implemented and approved by the Local Planning Authority.
i. "The following measures (a-d) shall be undertaken to investigate and remediate any contamination on the site prior to commencement of the development:
a) A desk study shall be submitted to and approved in writing by the Local Planning Authority. This study shall be conducted fully in line with the approach indicated in BS 10175: 2011 (Investigation of potentially contaminated sites - code of practice). The study shall include the identification of all previous site uses, potential contaminants that might reasonably be expected given those uses and other relevant information. If contamination is suspected at the site the information obtained must then be used to formulate an initial conceptual model for the site including all potential contaminant sources, pathways and receptors.
b) Where contamination is identified as having the potential to be present in a) above, proposals for a site investigation to characterise the site must be submitted to and approved in writing by the Local Planning Authority. This proposal shall be designed having regard to the approved desk study and BS 10175. It should be clear about what information it seeks to obtain and how this will refine the initial conceptual model for the site.
c) The approved site investigation referred to on b) above shall be fully implemented and a report submitted to the Local Planning Authority for written approval. The report shall be in line with BS 10175 and detail the works undertaken to characterise the site and contain a refined conceptual model in the light of the results of the investigation. N.B. If the Local Planning Authority is not satisfied that the site has been adequately characterised after the first stage of investigation, further works will be required to clarify any remaining uncertainties.
d) Where unacceptable levels of contamination are identified, a remediation scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall incorporate details of the procedures and documentation employed to validate the remediation measures identified in c) above.
ii. Prior to occupation of the site, the approved remediation and validation schemes in d) above shall be fully implemented and a report submitted and approved in writing by the Local Planning Authority.
Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use and in accordance with Policy H11 of the adopted South Oxfordshire Local Plan.
That no development shall take place until the method for piling foundations have been submitted to and approved in writing by the Local Planning Authority.
Reason: To prevent pollution of the water environment and in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.
That details of surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing.
Reason: In the interests of public health and to avoid pollution in accordance with Policy G6 of the adopted South Oxfordshire Local Plan.
That the parking provision shall be as shown on the deposited drawing, reference 1413/130 Rev 1 all constructed, surfaced and laid out, retained and maintained.
Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policy G11 of the adopted South Oxfordshire Local Plan.
That details of all external lights shall be submitted to and approved in writing by the Local Planning Authority before the development commences.
Reason: To ensure that the development is not unneighbourly and to reduce light pollution in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.
That all lighting apart from internal security lighting and the tripping of external security lighting shall be extinguished when the premises have closed and staff left the premises.
Reason: To ensure that the development is not unneighbourly in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.
