That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That except insofar as maybe otherwise agreed in writing by the Local Planning Authority the tree that exists on the land that is not to be enclosed by the fencing shall be retained and protected during the course of the development and for a period of five years following the completion of the development. In the event of the tree dying, being removed, seriously damaged or diseased within that period it shall be replaced with a similar size and species of tree unless the Local Planning Authority gives written consent to any variation.
Reason: To safeguard the character of the area in accordance with Policy H12 of the adopted South Oxfordshire Local Plan.
