Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That the relaxation of conditions 11 and 12, imposed on the planning permission dated 16 September 1985, issued in respect of application reference P85/W387/RM, shall only be relaxed insofar as they relate to the property now known as 3 Walnut Tree Court. Reason: That the condition is required to maintain control over the other boundaries of the Walnut Tree Close development, to secure the proper planning of the locality, in accordance with Policy CON8 of the adopted South Oxfordshire Local Plan.

That a scheme for the landscaping of the site, including the planting of live trees and shrubs, shall be submitted and approved in writing by the Local Planning Authority prior to the alterations to the fence. The planting shall be undertaken in accordance with the approved scheme in the first planting season following approval. The plants shall be properly maintained in accordance with details which shall be included in the scheme and in the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of being planted, a new tree or shrub shall be planted and the replacement shall be properly maintained. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.

That the replacement fence shall be dark stained within 3 months of its erection, in accordance with details which shall first have been submitted to, and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory in accordance with Policy CON8 of the adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of Article 3 of, and Class A of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no additional fences gates walls or other means of enclosure, other than expressly authorised by this permission shall be erected unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To safeguard the character of the area in accordance with Policy CON8 of the adopted South Oxfordshire Local Plan.

That the existing trees on the land shall be protected whilst development operations are in progress, in accordance with a scheme to be first agreed in writing with the Local Planning Authority and to be implemented prior to the commencement of the development. Reason: To safeguard trees which are visually important in accordance with Policy C16 of the adopted South Oxfordshire Local Plan.
