Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That samples of the materials to be used for the external walls and roofs shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: To ensure that the details of the development are satisfactory and to comply with policies G1 and H4 of the adopted South Oxfordshire Local Plan.

That a scheme for the hard and soft landscaping of the site, which should include details for the planting of live trees and shrubs, for the treatment of the access road, parking areas and hard standings for the provision of boundary fences, (including the enclosure of front garden areas with low fences, walls or railings) and screen walling, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. Reason: To help assimilate the development into its surroundings and to comply with Policies G1 and G9 of the adopted South Oxfordshire Local Plan.

That the approved landscaping scheme shall be implemented within 12 months of the commencement of the development hereby permitted. In the event of any of the trees or shrubs so planted dying or being seriously destroyed or diseased within 5 years of the completion of the development, they shall be replaced by an equivalent number of trees and shrubs of the same species in the next planting season following their demise, unless otherwise previously agreed to in writing by the local planning authority. Reason: To help to assimilate the development into its surroundings and to comply with Policies G1 and G9 of the adopted South Oxfordshire Local Plan.

Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with a scheme which complies with BS 5837:1991 Trees in Relation to Construction and shall have been submitted to, and approved in writing by, the Local Planning Authority. The agreed measures shall be kept in place during the entire course of development. Reason: To safeguard trees which are visually important in accordance with Policies G8 and C16 of the adopted South Oxfordshire Local Plan.

That the parking provision shall be as shown on the deposited drawing, reference 03123 - P02 all constructed, surfaced and laid out, retained and maintained. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities and to comply with Policies G1, H4 and G10 of the adopted South Oxfordshire Local Plan.

That details of surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing. Reason: In the interests of public health and to comply with Policies G1, G6 of the adopted South Oxfordshire Local Plan.

No development shall take place until a desk study shall have been submitted to and approved in writing by the Local Planning Authority. a) This desk study shall be conducted fully in line with BS 10175:2001 (Investigation of potentially contaminated sites - codes of practice) and identify all previous sited uses and the contaminants that might reasonably be expected and any other relevant information. The information must then be used to formulated an initial conceptual site model including all potential contaminant sources, pathways and preceptors. b) Where contamination is identified as having the potential to be present in a) above, proposals for a site investigation to characterise the site must be submitted to and approved in writing by the Local Planning Authority before any investigations are carried out. This proposal shall be designed having regard to the approved desk study and BS 10175. It should be clear about what information the investigation seeks to obtain and how this will refine the initial conceptual model for the site. The investigation must be comprehensive enough to enable a risk assessment relating to ground water, surface waters, current and future residents/site users and any other relevant receptors associated on and off site that may be affected. It must also be sufficient enough to enable production of any necessary Method Statements detailing the remediation requirements. c) The approved site investigation in b) above shall be fully implemented and a report submitted to and approved in writing by the Local Planning Authority. The report shall be in line with BS 10175 and detail the works undertaken to characterise the site and contain a refined conceptual model in the light of the results of the investigation. N.B if the Local Planning Authority is not satisfied that the sited has been adequately characterised then further works will be required to clarify the remaining uncertainties. d) Where unacceptable levels of contamination are identified in c) above, a remediation scheme detailing all works, procedures and validation measures to ensure the site is made suitable for its use, including measures to minimise the impact on ground waters, surface waters and on any other receptors that may be at risk, shall be submitted to and approved in writing by the Local Planning Authority. Prior to the occupation of the site, the approved remediation and validation schemes in d) above shall be fully implemented and a report submitted and approved in writing by the Local Planning Authority. Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use and to comply with Policies G1 and G7 of the adopted South Oxfordshire Local Plan.

That notwithstanding anything contained in the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no additional windows shall be constructed in the walls or roofs of the development . Reason: To ensure that the development is not unneighbourly and to comply with Policies G1 and H4 of the adopted South Oxfordshire Local Plan.
