The development hereby approved shall be carried out in accordance with the written details and plans approved in permission P89/W0605/CM unless modified by the conditions attached to this permission. Reason: For the avoidance of doubt and to ensure that the development is carried out in accordance with the approved plans and details. Policy: OSP EN1, EN2, OMWLP PE18

The deposit of chalk or other inert wastes hereby permitted shall cease on or before 30 June 2005 or such other later date that the Waste Planning Authority may determine in writing. Reason: To minimise the disturbance on the site. Policy: OSP EN1, EN2, OMWLP PE18

Restoration to a state suitable for agriculture in accordance with the conditions of this permission shall be complete by 30 June 2006 or within one year of the completion of waste disposal whichever is the sooner, or such other date that the Waste Planning Authority may determine in writing. Reason: To ensure early restoration of the site. Policy: OSP EN1, EN2, EN4, WD4, OMWLP PE13, PE18, W7

With the exception of any works necessary to a) Avoid danger to persons or animals; b) Prevent imminent pollution of any water system; c) Cope with emergencies due to vehicle breakdown or bad weather (but only then with the agreement of the Waste Planning Authority) no operations permitted or required by this permission shall be carried out except between the following times: 0700 hours to 1800 hours on Mondays to Fridays 0800 hours to 1300 hours on Saturdays and no operations permitted or required by this permission shall be carried out on the site on Saturdays or on a Bank Holiday. Reason: To protect the amenities of the local residents. Policy: OSP EN1, EN2, OMWLP PE18, W7

No access shall be used to the site other than that shown on plan 038/02A approved under permission P89/W0605/CM. Reason: To protect the amenities of local residents. Policy: OSP T18, EN2, OMWLP W7, PE18

Notwithstanding the provisions of the General Permitted Development Order 1995 as amended, or any order revoking or re-enacting that order, no fixed plant shall be located within the site. Reason: To protect the amenities of local residents. Policy: OSP EN1, EN2, OMWLP W7, PE18

Noise from the operations at the site shall not exceed 10 dB (A) Leq greater than the ambient noise level L90 as measured in any fifteen minute period at the boundary of the site except for the specific operations of stripping, storage and respreading of topsoil, subsoil and overburden or as the Mineral Planning Authority may agree in writing. Reason: To protect the amenities of local residents. Policy: OSP EN1, EN2, OMWLP W7, PE18

All plant and machinery operated on the site shall be fitted with suitable noise reduction equipment to satisfy condition 7. Reason: To protect the amenities of local residents. Policy: OSP EN1, EN2, OMWLP W7, PE18

No excavation or deposit of waste shall take place within 100 metres of the edge of the carriageway of the Icknield Way. Reason: To screen as far as possible any operations from the users of Icknield Way, residents of Clacks Farm and the gypsy site and to protect the pipeline. Policy: OSP EN1, EN2, EN4, OMWLP W7, PE18

Subsoil and topsoil shall be stripped, stored and respread separately from one another. Reason: To retain soil fertility. Policy: OSP EN4, WD4, OMWLP W7, PE13, PE18

No waste other than chalk and inert waste shall be deposited on the site. Reason: To ensure a high standard of restoration. Policy: OSP EN4, WD4, OMWLP W7, PE13, PE18

No stripping, storage or respreading of topsoil and subsoil shall take place unless the percentage moisture in each of the subsoil and topsoil is to be moved is less than the percentage moisture at the plastic limit of each of the topsoil and subsoil. Reason: To retain soil fertility. Policy: OSP EN4, OMWLP W7, PE13, PE18

The final restored levels shall be in accordance with a plan which shall be submitted to the Waste Planning Authority for approval within one month of the date of this permission. Reason: To ensure satisfactory restoration of the site. Policy: OSP EN4, WD4, OMWLP W7, PE13, PE18

Other than within the excavated area imported subsoil shall only be stored on areas where the deposit of waste has been completed and this storage shall not exceed 2 metres in height. Reason: To minimise the disturbance on site. Policy: OSP EN1, EN2, EN4, OMWLP W7, PE18

Any trees on the periphery of the site which die, are removed or become seriously damaged or diseased shall be replaced in the next planting season, or such other later date that the Waste Planning Authority may agree, with others of a similar species unless the Waste Planning Authority gives written consent to any variation. Reason: To reduce the visual impact of operations. Policy: OSP EN1, EN2, EN4, OWMLP W7, PE10, PE18

Imported subsoil shall be spread over deposited waste materials to an even depth so as to follow final contours and to be tined to at least 0.3 m depth at a spacing not exceeding one and a half times the depth of tining. Reason: To facilitate restoration of high quality agricultural land. Policy: OSP EN4, OMWLP W7, PE13, PE18

The stored subsoil shall be respread over the tined overburden and imported subsoil to an even depth so as to follow the final contours. The respread subsoil shall be tined or deeply cultivated so that any compacted layers are effectively broken up. Reason: To facilitate restoration of high quality agricultural land. Policy: OSP EN4, OMWLP W7, PE13, PE18

No rocks, stones or other solid objects exceeding 150 mm in any dimension shall be left within 0.9 metres of the surface before topsoil is replaced. Reason: To facilitate restoration of high quality agricultural land. Policy: OSP EN4, OMWLP W7, PE13, PE18

Topsoil shall be spread over the tined or cultivated subsoil to an even depth to achieve the final restoration levels approved under condition 14, and shall be subsoiled with an agricultural wing tine implement at a spacing not exceeding one and a half times the depth of topsoil. Reason: To facilitate restoration of high quality agricultural land. Policy: OSP EN4, OMWLP W7, PE13, PE18

No reversing bleepers or reversing warning devices shall be fixed to, or used on any mobile plant, except in accordance with details to be agreed by the Waste Planning Authority in writing. Reason: To protect the amenities of occupiers of nearby premises from unreasonable noise intrusion. Policy: OSP EN1, EN2, OMWLP W7, PE18

Aftercare of the site shall be carried out in accordance with an aftercare scheme approved by the Mineral Planning Authority. The aftercare scheme shall be submitted within 6 months of the date of this permission or such later date as the Waste Planning Authority may agree in writing. Reason: To ensure that the restored land is correctly husbanded. Policy: OSP EN4, OMWLP W7, PE13, PE18
