Conditions / Refusal Reasons
That the development be carried out strictly in accordance with the particulars of the development contained in application S.16/04 as shown on plan numbers 5020891/930/100/001 P1, 002 P1, 003 P1, 004 P1 and 005 P1 accompanying the application except as controlled or modified by conditions of this permission, unless otherwise agreed in writing by the Head of Sustainable Development. Reason: To ensure the details of the development are carried out in accordance with the application as approved.

That development must be begun not later than the expiration of five years beginning with the date hereof. Reason: By virtue of the provisions of Section 91 (1) (a) of the Town and Country Planning Act, 1990.

That the external walls and roofs of the buildings be constructed and finished in accordance with a Schedule of Materials and Finishes which shall first have been submitted to and approved in writing by the Head of Sustainable Development. Reason: To ensure the Materials and Finishes are compatible with the surrounding development. (Policy: G2 (OSP2011); G2 (OSP2016); G8 (SOLP); D1 (SOLP2011)).

That the land be landscaped and planted with trees and shrubs in accordance with a comprehensive planting and landscaping scheme, which shall be submitted to and approved by the Head of Sustainable Development in writing prior to the commencement of the development and that trees and shrubs so planted be properly maintained and that in the event of any of the trees or shrubs dying or being seriously damaged or destroyed within a period of five years from the completion of the development a new tree or shrub or equivalent number of trees or shrubs as the case may be, be planted and properly maintained in a position of positions as first approved by the Head of Sustainable Development. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development. (Policy: G2 (OSP2011); G2 (OSP2016)).

That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season following the occupation of the buildings or the completion of the development, whichever is the sooner, and any trees or plants which within a period of five years die, are removed or become seriously damaged shall be replaced in the next planting season with others of similar size and species, unless the Head of Sustainable Development gives written consent to any variations. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development. (Policy: G2 (OSP2011); G2 (OSP2016)).

That at the expiration of a period ending on 31 October 2006, or when the John Watson Special School building is completed, whichever is the sooner, the buildings be removed from the land and the land be left in a tidy and orderly state. Reason: In view of the temporary nature of the development. (Policy: EN1, G2 (OSP2011); G2 (OSP2016)).

That the School shall prepare a School Travel Plan which is to be submitted to and approved by the Head of Sustainable Development following consultation with the Travel Plans Development Team and that plan must be put into operation by the start of the Summer term following the date the building is brought into use. Reason: In the interest of highway safety and to encourage more sustainable means of transport. (Policy: T1 (OSP2011)).
