Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That no development other than the demolition shall take place prior to a detailed site investigation to establish if the site is contaminated, to assess the degree and nature of the contamination present, and to determine its potential for the pollution of the water environment. The method and extent of the site investigation, the remediation works and the method statement to verify that the required works have been carried out shall be as set out in the attached letter from the environment agency dated 19 May 2004 and the details of which shall be submitted to and approved in writing by the Local Planning Authority. The measures approved shall be completed before occupation of the buildings.
Reason: To ensure that the proposed site investigations and remediation will not cause pollution of Controlled Waters in accordance with Policies G1 and G7 of the adopted South Oxfordshire Local Plan.
That details of the method for piling foundations shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development on the site. The piling shall thereafter be undertaken in accordance with the approved details.
Reason: In the event that the site is contaminated, piling could lead to the contamination of the underlying aquifer.
That details of the foul and surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing. The details shall include the method of foul drainage for the washdown and drop pit facilities in particular.
Reason: To prevent pollution of the water environment in accordance with Policies G1 and G7 of the adopted South Oxfordshire Local Plan.
That no soakaways shall be constructed in contaminated ground.
Reason: To prevent pollution to ground water in accordance with Policies G1 and G7 of the adopted South Oxfordshire local Plan.
That the building be modified and finished in accordance with a schedule of materials and finishes which shall first have been submitted to and approved in writing by the Local Planning Authority before the development commences.
Reason: To safeguard the character of the area in accordance with Policies G1 and G8 of the adopted South Oxfordshire Local Plan.
That details of materials finishes and size of the proposed motorcycle and bike rack shall be submitted to and approved in writing by the Local Planning Authority prior to its construction.
Reason: To safeguard the character of the area in accordance with Policies G1 and G8 of the adopted South Oxfordshire Local Plan.
That the building as modified shall not be occupied until space has been laid out within the site for car parking, for the loading and unloading of goods and service vehicles and for vehicles to turn so that they may enter and leave the site in forward gear, in accordance with Plan Reference 359/SK004/SP accompanying the application and such areas shall not thereafter be used for any purpose other than that for which they are provided.
Reason: To comply with the Local Planning Authority's vehicle parking standards to protect local amenities in accordance with Policies G1 and G11 of the adopted South Oxfordshire Local Plan.
That a scheme for the landscaping of the frontage of the site, including the planting of live trees and shrubs, boundary fencing and the treatment of the hardstandings, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies G1 and G9 of the adopted South Oxfordshire Local Plan.
