Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That colours and samples of the materials to be used for the walls and roof shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of any part of the development. Reason: To ensure a satisfactory standard of design in accordance with Policies G1 and G8 of the adopted South Oxfordshire Local Plan.

The tree shown for retention on Drawing No. 211-GA-000-Z shall be protected in accordance with BS 5837 whilst development operations are in progress, in accordance with a scheme to be first agreed in writing with the Local Planning Authority and to be implemented prior to the commencement of development. Reason: To safeguard the character of the area in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

Details of external lighting that prevent upward spillage shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of any part of the development. Reason: To prevent light pollution and nuisance to neighbouring properties in accordance with Policy G8 of the adopted South Oxfordshire Local Plan.

That the rated level of noise from plant on site shall be 5 dB(A) below the background level. The noise levels shall be determined at 1 metre from the closest residential facade and the measurement and rating of the plant shall be made in accordance with the latest British Standard 4142 "Method for rating industrial noise affecting mixed residential and industrial areas". Reason: To safeguard the character of the area in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

That the building shall be closed to the public from 01:00 - 07:00 hours Monday to Friday and 02:00 - 07:00 hours on Saturdays and Sundays. Reason: To protect the residential amenities of the area in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.

That surface water shall not be disposed of other than in accordance with a detailed surface water drainage scheme which shall first have been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health and to avoid pollution in accordance with Policy G17 of the adopted South Oxfordshire Local Plan.

That the building shall incorporate a grey water recycling system that uses rainwater in accordance with a scheme to be submitted to the Local Planning Authority for approval in writing prior to the commencement of development. Reason: To provide a sustainable form of development in accordance with Policy G2 of the adopted South Oxfordshire Local Plan.

Details of the design and materials for the metal screen proposed to the rear of the building fronting Market Place shall be submitted for approval in writing by the Local Planning Authority prior to the commencement of development. Reason: To ensure a satisfactory standard of design in accordance with Policies G1 and G8 of the adopted South Oxfordshire Local Plan.

A scheme for landscaping that shall include a brick wall along the whole of the northern boundary shall be submitted for approval in writing by the Local Planning Authority. The wall shall be constructed prior to the first occupation of the cinema and retained thereafter. Details shall include height, design, materials and associated planting. Reason: In the interests of the visual amenities of the area in accordance with Policy G8 of the adoped South Oxfordshire Local Plan.
