Conditions / Refusal Reasons
The development hereby permitted shall commence within five years from the date of this permission. Reason: To comply with Section 91 of the Town and Country Planning Act 1990 and to minimise the duration of disturbance from the development hereby permitted. Policy: OMWLP PE13

The use hereby permitted shall cease not later than the expiration of 5 years from the date of commencement of the development. Written notification of the date of commencement shall be sent to the Waste Planning Authority within 7 days of such commencement. All structures and plant must be dismantled and removed from the site and the site restored to a clean and tidy state within one year of the expiration date. Reason: To enable the Waste Planning Authority to adequately control the development and to minimise its impact on the amenities of the local area. Policy: OMWLP PE1

The development shall be carried out solely in accordance with the approved submitted details except as modified by these conditions and as otherwise agreed by the Waste Planning Authority in writing. Reason: For the avoidance of doubt and to ensure the development is carried out in accordance with approved plans and details. Policy: OMWLP PE18

Except with the prior agreement of the Local Planning Authority in writing, no operations authorised or required by this permission shall be carried out and plant shall not be operated, other than during the following hours: Between 0700 and 1800 hours Mondays to Fridays Between 0700 and 1300 hours on Saturdays No such operations shall take place on Sundays or recognised public holidays. Reason: To protect the amenities of the local area. Policy: OMWLP W7(b) PE18

A corridor of land, 5 metres in width shall be maintained free of development between Culham UKAEA security fence to the west of the site and the composting clamp. Reason: In the interests of security of the Culham UKAEA Laboratories. Policy: OMWLP W7(b)

Prior to the commencement of the development the chain link fence to the east of the site should be fully repaired to the satisfaction of the County Council. Reason: To ensure that users of Clifton Hampden Public Footpath 10 do not stray onto the site. Policy: OMWLP PE11

No floodlighting shall be erected on the site without the prior approval of the Waste Planning Authority in writing. Reason: In the interests of the amenity of the area. Policy: OMWLP W3(c), W7(b)

No material other than green waste originating in gardens or parks but not waste originating in kitchens or any animal waste should be brought onto the site. Reason: To ensure that only green waste is processed at the site. Policy: OMWLP W3

No material shall be stockpiled, deposited or windrowed to a height exceeding 3 metres. Reason: In the interests of visual amenity. Policy: OMWLP W3(c) W7(b)

No compost shall be sold from the site. Reason: To minimise traffic generation and disturbance from the operation. Policy: OSP T18, OMWLP W3 W7

No materials, plant or temporary structures of any kind shall be placed on Clifton Hampden Public Footpath No 10. Reason: To prevent the obstruction of the public right of way. Policy: OMWLP PE11

No reversing bleepers or other means of warning of reversing vehicles shall be fixed to, or used on, any mobile plant or vehicles unless otherwise agreed in writing by the Waste Planning Authority. Reason: In the interest of the amenity of the area. Policy: OMWLP W3(c) W7(b)

Noise arising from the shredder shall not exceed 55dB(A) Leq (1 hour) free field when measured at a height of 1.2m above ground level and 3.5m from the facade of any occupied dwelling during any 30 minute period. Reason: To safeguard the amenity of the area and local residents. Policy: OMWLP W7(b), W3(c)

All reasonable steps shall be taken to ensure that all vehicles leaving the site are in such condition as not to emit dust or deposit mud, slurry or other debris on the highway. In particular (but without prejudice to the foregoing), efficient means shall be installed, maintained and employed for cleaning the wheels of all lorries leaving the site. Reason: In the interests of highway safety and the safeguarding the local environment. Policy OSP T18(f), OMWLP W3(c)

Unless with the prior agreement of the Waste Planning Authority in writing, no more than 6 vehicles carrying green waste shall enter the site in any one day. Reason: In the interests of highway safety and the safeguarding the local environment. Policy: OSP G4, T18(d), OMWLP W3(c)

In the event that there are complaints (which the County Council considers are justified) about smell from the site, then no waste shall be imported from the date the Waste Planning Authority notified the operator of nuisance until any scheme approved by the Waste Planning Authority is implemented; a scheme for mitigating the smell nuisance shall be submitted within one month of the Waste Planning Authority notifying the operator in writing that nuisance had occurred and that a scheme was necessary. Any scheme that was approved shall be implemented for the life of the development. Reason: To protect the amenities of the locality from the effects arising from the development. Policy: OMWLP W3(c), W7(b)

Windrows shall not be turned unless the wind strength at the site is at Beaufort Scale 4 or below or is blowing away from the village of Clifton Hampden. Wind direction shall be determined by a wind sock which shall be installed on the site within one month of the date of this permission and retained for the duration of the development. Reason: To protect the amenities of the locality from the effects arising from the development. Policy: OMWLP W3(c), W7(b)

No development shall take place until a detailed scheme for the landscaping of the site has been submitted to and approved in writing by the Local Planning Authority. The landscaping shall take place to the southern and eastern boundary of the site. The scheme shall include details of: The positions, species, density and initial sizes of all new trees and shrubs; The programme of implementation of the scheme The arrangements for subsequent maintenance The scheme as approved shall be carried out in full (unless with the prior approval of the Local Planning Authority in writing to a variation) Reason: The provision and maintenance of a satisfactory degree of landscaping is considered essential in the interest of visual amenity. Policy: OMWLP W5, W7(g)

The planting as shown in approved plan No. 1563/02A shall be carried out in the first planting season following the issuing of the permission. Reason: In the interests of visual amenity. Policy: OSP EN2, OMWLP W3(c), W5 W7(b) (k)

Trees and shrubs planted in accordance with the approved scheme shall be maintained and any plants which within 5 years of planting die or become damaged, shall be replaced in the next planting season. Reason: In the interests of wildlife and visual amenity. Policy: OSP EN2, OMWLP W3(c), W5, W7(b) (k)

All fuel tanks shall be sited on a concrete base surrounded by bund walls capable of retaining at lest 110% of the tank volume and any spillages from draw or fill pipes. Reason: To prevent pollution of the surrounding land, water and groundwater. Policy: OMWLP W3(d) W7 (c)

Areas of impermeable pavement, bunding and sills shall be constructed and maintained so as to prevent fluids (leachate) running off the pavement and the transmission of fluids from the pavement through joints. Reason: To prevent pollution of the surrounding land, water and groundwater. Policy: OMWLP W3(d) W7(c)
