Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That samples of the materials to be used for the external walls and roofs shall be submitted to and approved in writing by the Local Planning Authority before any development commences.
Reason: To ensure that the details of the development are satisfactory and
to comply with Policies G1, H11, H4 and H5 of the adopted South
Oxfordshire Local Plan.
That the existing hedge along the northern boundary of the land shall be retained and properly maintained at a height of not less than 1.5 metres, and that any plant which may die or be seriously damaged or destroyed within three years of the completion of the development shall be replaced and the replacement shall be properly maintained.
Reason: To help to assimilate the development into its surroundings and to
comply with Policies G1, H11 and H4 of the adopted South
Oxfordshire Local Plan.
A scheme for the hard and soft landscaping of the site, which should include details for the planting of live trees and shrubs, for the treatment of driveways, parking areas and hard standings ( including the enclosure of front garden areas with low fences, walls or railings) and screen walling, shall be submitted to and approved in writing by the local planning authority prior to the commencement of the development hereby permitted.
Reason: To help to assimilate the development into its surroundings and to
comply with Policies G1, H11 and G9 of the adopted South
Oxfordshire Local Plan .
The approved scheme shall be implemented within 12 months of the commencement of the development hereby permitted. In the event of any of the trees or shrubs so planted dying or being seriously damaged, destroyed or diseased within 3 years of the completion of the development, they shall be replaced by an equivalent number of trees and shrubs of the same species in the next planting season following their demise, unless otherwise previously agreed to in writing by the local planning authority.
Reason: To help to assimilate the development into its surroundings and to
comply with Policies G1,G8 , H11 and H4 of the adopted South
Oxfordshire Local Plan.
That notwithstanding anything contained in the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no additional windows shall be constructed in the walls of the development hereby approved facing east and west
Reason: To ensure that the development is not unneighbourly and to comply
with Policies G1, H11 and H4 of the adopted South Oxfordshire
Local Plan.
That the existing trees and hedges on the land shall be protected whilst development operations are in progress, in accordance with a scheme to be first agreed in writing with the Local Planning Authority and to be implemented prior to the commencement of the development.
Reason: To safeguard the character of the area and to comply with Policies G1
and C16 of the adopted South Oxfordshire Local Plan.
That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification.
Reason: In the interests of highway safety and convenience and to comply
with Policies G1 and G10 of the adopted South Oxfordshire Local
Plan.
That the parking provision shall be as shown on the deposited drawing, reference 2191/110/C all constructed, surfaced and laid out, retained and maintained.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities and to comply with
Policies G1 and G10 of the adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order) the garage accommodation shall be retained as such and shall not be adapted for living purposes without the prior grant of planning permission by the Local Planning Authority on a formal application in respect thereof.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities and to comply with
Policies G1 and G10 of the adopted South Oxfordshire Local Plan.
No surface water to be discharged into the public highway.
Reason: In the interests of public health and to avoid pollution and to comply
with Policies G1 and G10 of the adopted South Oxfordshire Local
Plan.
That notwithstanding the provisions of Part 1 Class E of the Town and Country Planning ( General Permitted Development) Order 1995 ( or any order revoking or re-enacting that Order), no outbuildings, swimming pools or other buildings incidental to the enjoyment of the dwellinghouses shall be erected on the land outlined in green on the attached plan.
Reason: To secure the proper planning of the locality and to comply with
Policies G1, GB2 and H5 of the adopted South Oxfordshire Local
Plan.
