Description
Erection of three detached dwellings with garages (as amended by drawing no.4A accompanying letter from Agent dated 29 January 2004 and revised certificate of ownership dated 29 January 2004 and as amended by drawing nos.1A, 2B & 5A accompanying letter from from Agent dated 2 April 2004 and drawing no.7A accompanying letter from Agent dated 1 July 2004).
Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced.
Reason: To safeguard the character of the area in accordance with
Policy H12 of the adopted South Oxfordshire Local Plan.
That prior to the commencement of any other development to which this permission relates, the means of vehicular access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the deposited plan reference 539-7A and all ancillary works therein specified shall be undertaken strictly in accordance with the said deposited plan.
Reason: In the interests of highway safety and convenience in accordance
with Policies G1 and G10 of the adopted South Oxfordshire Local
Plan.
That, prior to the commencement of development, full details of the existing ground levels on the site and the proposed slab level of the new dwellings shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the works shall be carried out in accordance with the approved plans.
Reason: To ensure that the details of the development are satisfactory in
accordance with Policies G8 and H4 of the adopted South
Oxfordshire Local Plan.
That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a scheme for the hard and soft landscaping of the site, which shall include the retention of all existing trees on the land unless shown to be removed on drawing no. 539-7A and their protection in relation to the laying of the access route; the position and type of materials to be used for hard parking/ turning areas and the position and description of all boundary treatments.
Reason: To help to assimilate the development into its surroundings in
accordance with Policy G9 of the adopted South Oxfordshire Local
Plan.
That all planting, seeding or turfing comprised in the approved scheme of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.
Reason: To help to assimilate the development into its surroundings in
accordance with Policy G9 of the adopted South Oxfordshire Local
Plan.
No tree that is to be retained shall be cut down, uprooted or destroyed, nor shall any retained tree be topped or lopped other than in accordance with the approved plans and particulars, without the written consent of the Local Planning Authority. Any topping or lopping approved shall be carried out in accordance with British Standard 3998 (Tree Work). The erection of fencing for the protection of any retained tree shall be undertaken in accordance with British Standard 5837 (Trees in Relation to Construction) before any equipment, machinery or materials are brought onto site for the purposes of carrying out the development, and shall be retained until all equipment, machinery and surplus material have been removed from the site. Nothing shall be stored or placed in any fenced area in accordance with this condition, and the ground levels within these areas shall not be altered, nor shall any excavations be made.
Reason: To protect the trees on the site in accordance with Policy C16 of the
adopted South Oxfordshire Local Plan.
That development shall not begin until a scheme for the disposal of sewage, foul and surface water has been submitted to and approved in writing by the Local Planning Authority and the works shall be completed in accordance with the approved details.
Reason:To ensure that the details of the development are satisfactory in
accordance with Policies G6 and H4 of the adopted South Oxfordshire
Local Plan.
